미국의 형사입법평가에 관한 연구: 사전적 평가를 중심으로

Analysis on Evaluation of Criminal Legislations in US: With its Focus on Ex-ante Evaluation

초록

형벌을 통한 대상자의 신체와 자유에 대한 침해는 사후적 보상을 통해서 회복할수 있는 종류의 침해가 아닌 이상, 형사 입법은 엄격한 사전적 평가를 통해 이뤄질 필요가 있다. 그럼에도 불구하고, 우리나라에서는 형사 입법안에 대한 사전적 평가를별도로 규정하고 있는 법제도가 아직 존재하지 않는다. 이에, 언론의 주목을 받는 사회적 이슈가 등장하면, 입법자들은 무분별하게 형벌을 수단으로 문제를 해결하고자하여왔고, 이로 인해 과도한 범죄화를 야기해왔다. 본 연구에서는 우리나라와 마찬가지로 동일하게 과도한 범죄화라는 문제를 겪고있는 미국의 형사 입법 사전적 평가 여부 및 내용에 대해서 살펴보고, 국내 형사 입법사전적 평가도입에 대한 함의를 살펴보고자 하였다. 그 결과, 미국은 ‘비례성’ 기반사전적 평가 도입의 필요성에 대해서는 인지하고 있으나 이를 회피한 채, 주로 인종으로 대표되는 인구 통계학적기준으로 형벌의 ‘형평성’ 기반 사전적 평가의 제도적도입을 확대해 오고 있다는 것을 알 수 있었다. 이에, 본 연구에서는 미국과 같이 특정 인구통계학적 기준이 불균형을 야기하는가라는 ‘형평성’ 기반 평가보다는, 형벌의 대상이 되는 행위를 억제하기 위한 적합하고, 필요하며, 균형성에 맞는 정당한 형벌인지에 대한 ‘비례성’ 기반 평가가 국내 형사입법에 대한 사전적 평가제도 도입의방향이 되어야 한다는 점을 강조하였다.

Abstract

Criminal Penalties incur irrecoverable harm against the freedom and body of the subjects. Thus, ex-ante rigorous scrutiny is required for the legislative proposals imposing criminal penalties prior to its adoption by the congress. However, legislative procedures in Korea fail to institutionalize such rigorous scrutiny. Accordingly, legislatures enjoy unrestrained freedom to utilize criminal penalties as a legislative tool to solve emerging social problems, thereby causing the problem of over-criminalization. This paper analyzes the existence and content of ex-ante evaluation of criminal legislations in US where the problem of over-criminalization has been increasingly intensified as in Korea. Based on the analysis, this paper illustrates that US has expanded its adoption of “fairness focused” ex-ante evaluation utilizing demographic criteria-which is generally represented by race-to compare the impacts of the proposed criminal penalties. On the other hand, the on-going efforts in US to institutionalize“proportionality focused” ex-ante evaluation analyzing whether the proposed criminal penalties are proper, necessary and balanced is yet to be achieved.
