미국의 시민 권리법 7조( Civil right Act 7), 영국의 평등법(Equality Act, 1975), 대만의 여성 주류화 정책 (2007), 프랑스 노동법 L1142조에 의해 경찰조직내의 성분할 모집을 폐지하였다. 동시에 성별에 따라 차별적 결과를 초래하는 체력시험을 완화 혹은 단순화해 왔다. 전통적 경찰의 역할은 범인검거, 질서 유지적 측면이 강조되어 왔다면 현대적 의미의 경찰은 시민과 소통하고 인권을 보장하는 사회적 분쟁과 문제해결자로의 측면이 더욱 중요해지고 있다. 이에 2020년 경찰대학과 간부후보생 채용시험에서 남녀성분할 모집을 폐지하겠다고 발표 하였으나 체력기준은 강화될 전망이다. 외국의 경우에는 영국은 Bleep test와 Push & Pull 로 남녀 동등한 기준으로 평가하고 있어 여성에게 불리한 기준을 최대한 없앴다. 대만도 달리기와 넓이뛰기로 종목이 2개이고 남녀의 합격기준도 상이하다. 여성 주류화 정책이 일환으로 여성 인력을 최대한 활용한다는 취지이다. 미국의 경우도 직무관련성이 있는 장애물넘기, 방아쇠당기기, 더미끌기, 자동차 타고 내리기등의 종목으로 남녀차이가 발생하지 않는 종목으로 변경해 가고 있다. 프랑스도 직무관련 종목으로 체력검정을 실시하고 채점기준은 남녀 차이가 있다. 성분할모집 폐지의 취지는 여성인력 활용과 여성인권보호를 위해 여자경찰의 진출을 도모하고자 하는 것이다. 하지만 이에 우선하여 특정 성별에 불리하지 않은 공평한 체력시험 기준이 마련되어야 할 것이다.
Abstract
According to ‘The Civil Right Act 7’ in USA, ‘Equality Act’ in UK(1975), ‘the Gender main stream policy’ in Taiwan(2007), France Labour Act, the police gender division recruitment was abolished. Simultaneously, they lowered the fitness test standard because of the gender discrimination result. The traditional police emphasized the criminal arrest, order maintenance but the present police regard the communication with citizens, protecting human rights and solving the problems are more important. In National Police University student recruit and a police cadet recruit, Police Agency will pick the new student without any gender-based quarter. However, the physical test standard will rise. UK police fitness test is composed of Bleep-test and Push-Pull test which got rid of the disadvantageous standard for women. Taiwan police fitness test is running and Jumping , the pass standards are different from gender. US police physical test is related with the police work and the test consists of obstacle-jumping, pulling-trigger, dummy-pulling etc. There is no different fitness test standard between men and women. France police fitness test is also related with police-work and the pass standard is equal for both gender. The gender-based recruitment abolition is aim for the women power use and the women right protection . For these aims, Korea Police Agency should prepare the equal fitness test standard for both gender.
