2000년 이후 이혼법 개정과 지역 이혼율 변동의 관계

초록

이혼법 개정으로 2008년 6월 이혼숙려제도, 2009년 8월 양육비부담조서 의무화 제도가시행되었다. 본 연구의 목적은 2000년 이후 지역 이혼율 변동 추이를 분석함으로써 개정된이혼법이 이혼율에 미친 영향을 실증적으로 살펴보는 것이다. 인구동향조사, 인구총조사, 주민등록인구현황, 경제활동인구조사의 자료를 활용하여 경제활동참가율, 실업율, 혼인율, 재혼율, 미성년인구비율, 초혼연령, 성비를 구성하였고, 2000년부터 2015년까지 16개 시도총 256개 데이터를 중심으로 이혼법 개정의 시점 전후 시도별 조정이혼율의 변동 양상을 고정효과 패널분석방법으로 분석하였다. 분석결과, 개정 이혼법은 사회경제 및 인구학적 요인을 통제한 상태에서도 이혼율의 감소추세에 영향을 미쳤고, 그 감소정도가 점차 증가하는 것으로 나타났다. 이를 통해 이혼법과 지역 이혼율 변동 사이에 관련성이 있음을 확인하였다.

Abstract

The revised divorce laws which include the compulsory cooling-off period in June 2008 and the child support consent agreement on the consensual divorce act in August 2009 have been enforced. This study investigated the effects of the revised divorce laws on divorce by analyzing the changes of regional divorce rates since the 2000s. For the analysis, I used the Vital Statistics data, the Population Census data, the Registered Population data, the Economically Active Population data. Using these data, I composed variables such as participation rates of economic activity, unemployment rates, remarriage rates, ratio of underage population, age of first marriage, and sex ratio. The analysis of the regional divorce rates before and after the revision of the divorce laws was carried out by a total of 256 samples of 16 regions were drawn from 2000 to 2015. The result shows that the revised divorce laws influenced the declining trend of divorce rate controlling for the socio-economic and demographic factors, which confirmed that there is a relation between the divorce laws and the divorce rate changes.
