한국에서 편집권에 관한 논의는 꽤 오랜 역사를 가지고 있지만 이론적 입론은 아직 미비한 실정이다. 편집권 독립의 문제는 공적 과업을 수행하는 민주주의 제도로서의 측면과 사적 영리를 추구하는 상업적 기관으로서의 측면이라는 언론의 이중적인 성격에서 발생한 것으로서, 그 핵심 내용은 언론사 내부에서 편집인 측이 발행인 측에게 독자적인 지위를 주장할 수 있는지 그 여부와 정도에 관한 것이라고 할 수 있다. 하지만 편집권의 문제를 단순히 언론사 내부의 권한 배분 문제로만 한정해서는 편집권이 가지고 있는 기본권적 측면을 제대로 파악할 수 없다. 편집권의 문제는 공정하고 진실한 보도를 통해 국민의 알권리를 실현하고 건전한 여론형성을 통해 민주주의에 기여한다는 언론의 공적 과업과 밀접한 관련이 있기 때문이다. 이를 시정하기 위한 한 방법은 언론 자유의 관점에서 접근하는 것이다. 이 글의 목적은 편집권 독립 혹은 언론의 내적 자유를 이해하는 이론적 관점들을 정리하고 그 의미를 논의하는 데 있다. 구체적으로 이 글에서는 편집권의 개념과 논의의 전개과정을 간단히 살펴본 다음 편집권 독립의 문제를 언론의 자유라는 기본권적 측면에서 파악하고 그 함의를 논의했다.
Abstract
Considering to quite a long history of debates on the problem of the editorial right in Korea, there have been very rare efforts for rigorous theoretical inquiries into that issue. Being raised from the dual aspects of the press as democratic institutions that perform public tasks on the one hand and commercial institutions that pursue private profits on the other, the question of editorial independence has been mainly concerned with whether reporters or editorial workers can claim an independent status against the publishers or owners within a media organization. However, when we confine editorial independence to the question of internal distribution of rights or competences between publishers and reporters, the aspects of basic rights related with editorial independence, such as right to know, right to access, and freedom of expression, would be hardly captured. One way to correct this would be to base the question of editorial independence on the principle of freedom of the press. The purpose of this paper is to point out theoretical perspectives on editorial independence or internal freedom of the press and to discuss their implications for freedom of the press in general. Specifically, after providing a short review of the concept of the editorial right and a short history of theoretical and practical developments on the question of editorial independence in Korea, this paper founded the question of editorial independence on the principle of freedom of the press and discussed its implications for enlarging the democratic accountability of the press.
