지식정보사회 관련 기본법제의 개정방향과 내용에 관한 연구

Abstract

Today's result of informatization promotion in Korea is based on the Framework Act on Informatization Promotion, enacted in 1995, which enables to establish informatization policies effectively. The Framework Act on Informatization Promotion has been conducted as a mother law for other related laws. However, the Framework Act on Informatization Promotion reached at uppermost limit due to the informatization is almost constructed at least in the field of mechanical devices by and large. Nevertheless the Framework Act on Informatization Promotion has taken its role for the government policies, promoting informatization system and establishing constituencies of the informatization, has not been performed as a law that could bind on the whole. Expecially, the lack of the functional role by the Informatization Promotion Committee is caused to revise the act for future knowledge information society. Under the Framework Act on Informatization Promotion, "focusing on the knowledge information", "more activating knowledge information" and "cooperation between public and private sectors" can be carried out, but "focusing infrastructure", "mechanical device" and "leading by the government" were the key issues on the Act. Thus, it is necessary to establish an legal system to offer a nationwide vision for the Information Society, not to promote informatization. In addition, we have to make a fundamental law system to work as a base for IT policy making and programming.
