Abstract

An environmental impact assessment (EIA) is an examination of the environmental consequences of a plan, policy, program, or actual projects prior to the decision to move forward with the proposed action. It is well-established practice to conduct EIAs for activities that are likely to cause negative impacts to the environment. The general provisions on EIAs are well provided not only under domestic instruments, but also under various international instruments. The EIA procedures established under the Convention on the Prevention of Marine Pollution by Dumping of Waste and Other Matter (London Convention) and 1996 Protocol to the Convention on the Prevention of Marine Pollution by Dumping of Wastes and Other Matter (London Protocol) are particularly noteworthy, as they provide specific standards and requirements for the conduct of EIAs. These procedures would seem to be useful sources and guidelines for designing and structuring EIAs under future international instruments. Thus, this paper thoroughly examines the elements and characters of the EIA procedures provided under the London Convention and Protocol as well as relevant instruments associated with ocean fertilization activities, and points out some of the elements that should be considered for the future developments of EIAs.
