지능정보사회의 규범설정 기본원칙에 대한 고찰

최근 지능정보기술에 기반 한 지능정보화의 급속한 진전으로 전 세계적으로 경제시스템과 사회구조를 근본적으로 변화하는 패러다임의 전환기에 있다고 할 수 있다. 이러한 지능화된 서비스는 우리의 삶의 질을 향상시키고 새로운 지식에의 접근성 향상 등으로 새로운 기회를 제공할 것으로 예상 된다. 반면 노동대체, 부의 양극화, 프라이버시 침해 등 우려도 크다. 따라서 본 연구는 바람직한 지능정보사회의 안착, 즉 인간에게 이로운 ‘지능정보사회’의 구현을 위해 반드시 필요한 입법정책 방향과 기본원칙을 제안하였다. 입법방향으로 i)’지능정보사회 인프라‘ 의 구축, ii) 국가사회 신뢰구축을 위한 위기관리시스템의 마련, iii)기술 중심 입법 한계 타파를 제안하였다. 그리고 지능정보사회 규범설정시 반드시 지켜져야 하는 기본원칙으로 i)인본중심 기술구현, ii)인간의 권리유일성, iii)무차별․공정서비스, iv)사회책임의 강화, v)사생활의 존중, vi)인간의 일할 권리 보장을 제안하였다.
Abstract
In recent years, based on intelligence information technology, intelligence information society is being progress rapidly and It can be said that we are at the turn of the paradigm the world economic system and social structure are fundamentally changing. These intelligent services is expected to enhance our quality of life, improve the accessibility to the new knowledge and open new opportunities. Whereas there is even greater concern, such as labor substitution, wealth polarization and invasion of privacy. Therefore, this study proposes the legislation policy directions and basic principles necessary for the implementation of intelligence information society benefit to humans. Legislative policy directions are as follows:: i) construction of intelligent information society infrastructure, ii) preparation of a crisis management system in order to ensure social reliability, iii) Overcoming limitations of technology - oriented laws. And the basic principles that must be observed when setting norms of intelligence information society is as follows: i) the technical implementation that Humanism is centered up, ii) the uniqueness of human rights, iii) without discrimination, fair service, iv) the strengthening of social responsibility v) respect for privacy, vi) ensuring human rights to work.
