지방자치법상 ‘예산 외의 의무부담’에 대한 재정관리 강화방안

이 연구는 지방자치단체가 민간의 자원을 활용하는 사업에서 자주 활용하고 있는 ‘예산 외의 의무부담’에 대한 자치단체의 운용실태를 분석하고 재정관리 강화방안을 모색하였다. ‘예산 외의 의무부담’행위는 사실상의 재정행위이나 절차적 통제가 미흡하고, 미래에 부담하는 재정적 비재정적 의무로 인하여 자치단체 재정위기를 초래할 가능성이 있음에도, 그동안 재정관리 규범대상에서는 제외되어 왔다는 것이 문제이다. 이에 중기재정계획, 지방재정영향평가, 지방재정투자심사, 우발부채관리, 재정공시제도 등 제도를 활용한 예산 외의 의무부담에 대한 재정관리 강화가 요구된다.
Abstract
This study analyzed the operating conditions of local governments’ financial guarantees, which are frequently used in public-private partnership projects to obtain private companies’ involvement, and sought ways to strengthen financial management on a contractual guarantee. A financial guarantee is one of the financial activities of local government in nature, but its procedures are not sufficiently in control in that guaranteed contract will have no impact on the local government’s fiscal position unless they are called. Although there is a possibility of causing a local financial crisis due to future obligations, it has been excluded from the target of local fiscal management rules. Accordingly, it is required to strengthen financial management using systems such as medium-term financial plan, local fiscal impact assessment, local fiscal investment review, and fiscal disclosure system.
