중간처우의 집 : 미국의 경험을 중심으로

중간처우의 집이 2009년 1월 안양 교도소에 국내 최초로 설치, 운영되면서 이 프로그램에 대한 관심이 높아지고 있다. 학계에서 중간처우의 집에 대해 깊이 있는 논의가 없었던 만큼 이 프로그램의 정의, 운영방식, 운영 중 생겨날 수 있는 문제점에 대하여 논의할 필요성이 제기되었다. 또한 이 프로그램이 수형자의 재통합과 재범감소에 도움이 되는 것인지를 알아보기 위해 문헌연구를 통하여 미국의 경험을 정리하였다. 미국의 경우에 중간처우의 집의 역사가 길고, 주 정부마다 필요에 따른 다양한 프로그램을 운영하고 있으며, 사설기관이 중심이 되어 다양한 고객을 상대로 하고 있고, 역사적으로 교정 이념이 바뀌면서 새 이념에 적응한 프로그램이 생겨난 결과, 매우 다양한 형태가 존재하고 있는 것으로 나타난다. 국내에서 중간처우의 집이 추구해야 할 목표와 이 프로그램의 재범감소 효과, 비용 효율성 검증을 포함한 앞으로의 연구방향과 정책적 함의를 논의하였다.
Abstract
Since the first halfway house was established on January, 2009 right next to the Anyang Correctional Institution, we have witnessed a steep increase of interest in this program. In the light of the fact that the academic circles have not studied halfway house in Korea, there are strong needs to discuss about the definition, management, and possible problems in operation of halfway houses. This study tries to provide informations about halfway houses through literature reviews of the American halfway houses. Special attention is given to the evaluation of the program in terms of recidivism and reintegration. Halfway house programs in the U. S. are characterized by diversity resulting from its long history, different target populations depending on the each state's needs, administration by either public or private agency, and its adaptation to change into deterrence, incapacitation, punishment-oriented criminal policy. This paper also suggested research topics for further studies and discussed policy implications.
