영국의 교도소 개혁 전략 및 특징에 관한 연구

초록

영국은 지속적인 형사사법제도의 개혁으로 교정비용 절감 및 재범률 감소 등 개혁의 성과가 나타나고 있다. 영국의 교도소 개혁의 특징은 다음과 같이 정리할 수있으며, 이를 통하여 우리나라의 교정처우 제도 개혁정책을 모색해볼 수 있다. 첫째, 개혁의 일관성이다. 보수당정부 때부터 신노동당, 그리고 연합정부는 이전정부의 개혁정책을 계승하고, 문제를 보완하는 방식으로 교도소 개혁 정책을 추진하였다. 둘째, 지속적인 법적 정비이다. 1991년의 형사사법법의 제정 및 2003년 동법의 개정, 2007년의 범죄인관리법, 2009년 검시관 및 법관법 등 개혁에 필요한 법적 토대를 갖췄다. 셋째, 정부 차원의 마스터 플랜을 가지고 단계별로 추진되었다. 2007년의 카터보고서 및 2010년의 그린보고서 등 종합적이고 거시적인 교도소 개혁계획을 가지고추진하였다. 넷째, 교도소간 경쟁시스템을 도입하였다. 2003년 형사사법법, 2007년 범죄인관리법 등은 형사사법기관의 경쟁시스템을 도입하고, 교도소와 보호관찰소, 그리고 민영교도소와 민영보호관찰 등의 성과를 평가하고, 그 결과에 따라 공영의민영화, 민영의 공영화 전환체제를 정착시켰다. 다섯째, 형사사법처우 기관의 성과평가지표를 개발하였다. 교도소와 보호관찰소등의 성과평가에 필요한 지표를 개발하여 활용하여 평가의 객관성 및 공정성을 확보하였다. 여섯째, 2004년 범죄인관리청을 내무부에 설치했지만, 2007년 법무부로이관하여 형사사법시스템의 효과적인 지휘감독체제를 구축했다. 일곱째, 수용자의노동은 교도소의 본래의 기능인 처벌과 피해자를 포함한 사회배상을 강화하는 관점에서 강력하게 추진되었다. 여덟째, 임시석방제, 간헐적 구금, 사회내처우와의 연계등 구금처우의 다양한 집행방식으로 교도소는 범죄인의 재사회화 역량을 강화하는데 초점을 두고 있다. 아홉째, 교도소는 공공보호협의회 등과 같이 경찰, 교육당국, 법원, 자원봉사자, 민영회사 등과의 협력적 네트워크를 범죄인의 재범방지 및 사회복귀역량을 강화하고 있다.

Abstract

UK have been on criminal justice system reformation during last 30 years. Finally, there are offender treatment cost savings and reduced recidivism in UK. We can learn the benefits through the reform of the criminal justice system in the UK. Features of the criminal justice reform in the UK are as follows. First, it is consistent reforms. criminal justice reform was started when the Conservative government, since the government has continued to the New Labour government and the coalition. And reforms of the previous government were supplemented by later governments. Second, the legal system has continued. It can be cited the Criminal Justice Act of 1991, enacted the criminal justice act of 2003, the offender management act of 2007, coroners and justice act of 2009 as a legal representative. These laws became the foundation necessary for reform. Third, it was promoted step by step with the master plan of the government. Typically there is a carter reports of 2007 and green report of 2010. Fourth, the UK introduced a competition between prison systems. Public prisons and private prison were switched depending on the performance evaluation results. Fifth, the UK has developed an objective and fair performance evaluation indicators for the treatment of criminal justice. Sixth, the UK has established an effective supervision system of the criminal justice system by transferred NOMS to the Department of Justice Administration at the Ministry of the Home in 2007. Seventh, the prison has been recognized as a place to work, which was promoted by inmates of the social dimension compensation. Eighth, prisons are re-socialization focuses on strengthening the capacity of criminal enforcement in a variety of treatment methods of detention. Ninth, the role of prisons is recognized that strengthening the capacity of criminal recidivism prevention and rehabilitation through the cooperation of the police and education authorities, courts, volunteers, private correctional companies.
