재범예측지표를 활용한 고위험 범죄자 처우의 과학화 방안

본 논문은 재범예측결과에 따른 고위험 범죄자 사회복귀 모형을 적용하여 범죄자를과학적으로 관리 및 처우하여 재범률을 줄이는 것을 목표로 한다. 이러한 목표를 수행하기 위해 선별적 사회복귀 이론(Selective Incapacitation)의 기초가 되는 가설을 검증하기 위해 교정시설 출소자의 재범여부에 대한 추적조사와 통계분석을 실시하였다. 이러한 과정을 거쳐 연구한 결과를 종합하면 소수의 가장 활동적인 누범자 집단이 다수의강력범죄를 범하기 때문에 이들을 선별하여 집중적인 관리와 처우를 실시한다면 성공적인 사회복귀가 가능할 것으로 기대된다. 아울러 재범예측결과에 따른 선별적 사회복귀모형에 대한 연구결과가 향후 고위험 범죄자의 과학적 처우를 통한 재범방지 대책에유용하게 활용되기를 기대한다.
Abstract
This paper aims to reduce recidivism rates in the use of scientific management & treatment of high risk offenders based on the model of modified selective incapacitation. It has been carried out that follow up studies & statistics analysis on the recidivism of released prisoners for the theory of hypothesis testing to achieve the aim mentioned above, and a survey was conducted to set the direction for the correctional policy targeted to the right people. The results of this study are summarized as follows. To sum up, due to the fact that a small number of the most active repeat offenders are likely to commit the most serious crimes, should intensive management & treatment be implemented to them through selection, it might be expected to have the effective crime control. In addition, it is anticipated that this study initially attempted on the management model of high risk offenders can be diversely utilized for the countermeasures to prevent crimes through the scientific treatment of high risk offenders.
