교정시설 수용자 교육의 한계 및 형집행법령 개정 방향

교정시설의 수용자 교육은 수용자의 기초학력 향상, 출소 후 사회적응과 고용기회를확대한다는 측면에서 매우 중요하다. 그런데 대부분의 국가에서 일반국민의 학력수준보다 수용자의 학력수준은 매우 낮은 것으로 나타났다. 우리나라의 경우에도 수용자의학력수준은 일반국민 보다 현저하게 낮아 수용자의 기초교육 강화의 필요성이 제기된다. 이 연구는 국제인권법과 현행 형집행법령의 수용자 교육 관련 규정을 비교하고, 국제인권법상 규정된 수용자 교육 수준에 달할 수 있도록 현행 형집행법령의 그 개정방향을 다음과 같이 제시하였다. 첫째, 현행법은 국제인권법상 그리고 헌법상 보장된 교육권 규정이 명확하지 않다. 또한 교정시설 학교교육이 수형자 중심으로 진행되고 있다. 둘째, 수용자 중 문맹자, 청소년, 의무교육 미이수자 등에 대한 기초학력 교육기회가 부여되어야 한다. 셋째, 수용자 교육과정은 국가기관의 일반 교육과정과 통합되어야 한다. 넷째, 교정시설 내 학교교육은 일정한 교육시설을 갖추고, 전문교사에 의해 이루어져야 한다. 다섯째, 모든 교정시설은 도서관을 갖추고, 교육, 문화, 오락 및 예술 등의복합적 공간으로 활용될 수 있어야 한다. 여섯째, 미결수용자에 대한 교육기회를 확대하고 근거 규정을 명확히 하여야 한다. 일곱째, 수용자 교육은 지역사회의 학교교육, 도서관 및 전문인적자원 등과 연계되어야한다. 여덟째, 수용자 학사과정에 대한 근거를 상위법인 형집행법에 두어야 한다. 아홉째, 교육이 수용자 재사회화에 어떤 영향을 미치는지에 대한 국가적 차원의 추적조사가 필요하다.
Abstract
The prison education is very important in terms of improving the prisoners' basic academic skills and expanding social adaptation and employment opportunities after release. This study compares the provisions related to the prison education in the international human rights law and the current the, prison laws and suggests a direction to improve the current prison laws so that the education of prisoners prescribed in the international human rights law can be achieved. First, the current law is not clear about the provisions of the right to education guaranteed under international human rights law and constitution. In addition, prison school education is being conducted centered on sentenced inmates. Second, among the inmates, opportunities for basic education should be given to those who are illiterate, youth, and those who have not completed compulsory education. Third, the inmate curriculum should be integrated with the general curriculum of state institutions. Fourth, school education in correctional facilities should be provided with certain educational facilities and should be conducted by professional teachers. Fifth, all correctional facilities should have a library and can be used as a complex space for education, culture, entertainment, and art. Seventh, the education of prisoners should be linked to school education, libraries, and professional human resources in the community. Eighth, the grounds for the inmate's undergraduate course should be based on the higher prison laws. Ninth, a follow-up survey at the national level is needed to see how education affects the resocialization of inmates.
