교정처우의 목적인 수형자의 사회복귀를 달성하기 위해서는 무엇보다 수형자의 개별적인 특성을 고려한 교정교육프로그램의 실시는 필수적이라 할 수 있다. 또한 이러한 교정교육프로그램은 교정환경의 변화에 맞추어 지속적인 발전이 있어야 기대하는 효과를 얻을 수 있다. 최근 우리의 교정상황은 과밀수용의 문제와 더불어 소위 처우곤란수형자라고 할 수 있는 마약류 및 폭력범죄자의 재범률증가가 눈에 띄게 증가하고 있으며, 고령화 사회의 진전에 따른 노인수형자의 수도 함께 증가하고 있다. 이러한 수형자들은 재범률이 높으며 또한 형기도 장기화된다는 점을 고려할 때 과밀수용의 원인으로 작용하는 것뿐만이 아니라 보다 실효성 높은 교정교육의 실시를 저해하는 요인으로도 작용하게 된다. 그럼에도 불구하고 현재 이러한 처우곤란수형자에 대한 전문적인 교정교육프로그램이 마련되어 있지 않고 또한 이를 담당할 전문 인력의 부족 등에 따라 효과적인 교정교육이 이루어지고 있지 않는 것이 우리의 현실이다. 마찬가지로 노인수형자에 대해서는 아직까지 노인전용교도소가 설치되어 있지 않고, 또한 노인수형자의 특성을 고려한 교정교육프로그램은 전무한 실정이다. 오늘날의 교정이념은 사회와의 재통합으로 옮겨가고 있다. 이에 따라 교정교육의 방향도 수형자의 사회복귀를 위한 가장 적합한 형태로 정립해 나아가야 하며, 또한 사회의 이해와 지원, 그리고 협조를 최대한으로 끌어낼 수 있는 교정교육프로그램의 개발과 실시를 교정시설에 기대하고 있다. 이에 본 연구에서는 우리의 교정환경의 변화와 이에 따른 교정교육프로그램의 문제점, 그리고 새로운 교정교육프로그램의 도입필요성 등에 대해서 서술하는 것을 목적으로 하였다.
Abstract
In order to achieve prisoners’ social rehabilitation, which is the goal of correction, it is essential to execute correctional education programs in consideration of prisoners’ personal characteristics. Furthermore, such correctional education programs can produce expected results when they make continuous improvement in accordance with changes in correction environment. Recently, together with the problem of crowded accommodation, there is a significant increase in the second offense rate of drug‐related and violence‐related criminals who are so‐called intractable offenders, and the number of elderly prisoners is also increasing with the advance of aged society. Considering that these prisoners show a high second offense rate and serve a long term of imprisonment, they not only cause crowded accommodation but also hinder the execution of more effective correctional education. Nevertheless, there is no correctional education program specialized in such intractable offenders, and are few experts who can carry out effective correctional education. Likewise, we do not have an elderly prison for aged offenders, and there is no correctional education program reflecting elderly prisoners’ characteristics. Today’s philosophy of correction is evolving to integration with society. Accordingly, correctional education should be developed into the form optimal for prisoners’ social rehabilitation. Furthermore, correctional facilities are expected to develop and execute correctional education programs that can induce the society’s understanding, support and cooperation as much as possible. Thus, this study purposed to discuss changes in our correction environment, resultant problems in correctional education programs, and the necessity for introducing new correctional education programs.
