아동･청소년 디지털 성착취 현황 및 플랫폼 규제에 관한 연구: 미국･캐나다･호주의 온라인 아동 성매매와 성착취물 법제를 중심으로

초록

해외 메신저나 랜덤 채팅앱 등의 온라인 플랫폼을 통해 디지털 성착취 범죄가 매우 증가하였으며 피해자들의 피해는 끊이지 않고 있다. 특히 이러한 디지털 성착취 범죄는 아동･청소년을 대상으로 하는 경우도 많으며 정보통신기술의 발달로 가해자를 검거하기도 쉽지 않다. 이러한 디지털 성착취 문제는 이용자를 검거해도 새로운 플랫폼을 개발, 변형하는 식으로 반복되고 있으나 현재 국내에서는 디지털 아동성착취물이 유포되는 플랫폼이나 서비스 제공자, 운영자 등을 처벌하는 기본적인 근거는 마련되어 있으나 실제 적용된 사례는 없는 상황이다. 본 연구는 해외의 디지털 성착취물 관련 현행법과 판례 등을 소개, 분석하는 과정을 통해 향후 국내 플랫폼 처벌 방안 모색을 목표로 삼는다. 구체적으로는 미국, 캐나다, 호주 등 세 국가의 디지털 성착취물 관련 용어 정의, 관련 법령 및 적용 판례, 피해자 구제 방안 등을 제시한다. 분석 결과 실제 디지털 성착취물이 전시, 판매되는 플랫폼 자체가 처벌되는 사례는 국내에서는 없는 것으로 파악된다. 그러나 미국을 중심으로 디지털 성착취 문제에 대한 경각심이 커지면서 플랫폼을 엄격하게 제재하는 사례와 소송 자체가 증가하고 있음을 확인할 수 있었다. 국내에서도 플랫폼 처벌과 관련한 현실적인 문제들을 고려하되, 무분별한 성착취물 유포에 대한 책임과 감시의 의무를 플랫폼으로까지 확대하기 위한 시스템적인 규제가 마련되어야 한다.

Abstract

The number of digital sexual exploitation crimes has significantly increased via online platforms including global mobile messaging apps and anonymous random chats, causing persistent harm to victims. In particular, such online sexual exploitation crimes often target children and adolescents, and perpetrators are difficult to apprehend because of the development of information and communication technology. The recurring problem of online sexual exploitation is due to the development and transformation of complementary platforms despite the arrest of service users. Although there are fundamental bases in Korea to punish digital platforms, internet service providers, and operators in which digital sexual exploitation materials are distributed, there are no real-life cases of application. This study aims to explore ways to punish domestic platforms in the future through the process of introducing and analyzing current laws and precedents related to online sexual exploitation in foreign countries. The three countries, including the United States., Canada, and Australia, present the definition of terms related to digital sexual exploitation, related laws and applied precedents, and measures of remedy of victims. As a result of the analysis, it is understood that there are no cases in Korea in which an online platform that has displayed and sold sexual exploitation material was punished. However, as awareness of digital sexual exploitation has grown around the U. S., the number of cases and lawsuits that strictly sanction the platform has increased. In Korea, while considering the practical problems related to the punishment of digital platforms, there is a need for systematic regulations to extend the responsibility for indiscriminate distribution of sexual exploitation and the duty of monitoring to the platform.
