남･북한 교정행정 통합방안에 관한 연구

남북 분단 78년 현시점에서 정치, 경제, 문화, 사회체제, 모든 부문의 통합이 중요하지만 남･북통일 후 국가와 사회의 안정을 위해서는 사법행정 그중에서도 교정행정의 통합은 매우 중요하다고 본다. 정치적으로 복잡한 사정 속에 시간이 흘러 가상하여20년 후인 2044년에 남･북 통일이 된다고 해도 준비 시간은 길지 않다고 생각된다. 이것은 동･서독통일 후 41년이 지난 지금까지도 깊은 후유증을 겪고 있는 통일독일을보면 쉽게 판단할 수 있을 것이다. 한반도는 남･북 통일의 과제를 남･북한의 새로운역사에서 완전히 삭제 할 수가 없다. 독일통일과정과 남･북한은 확실하게 복잡한 부문에서 비슷한 부문도 존재하지만 다른 부문도 존재한다. 따라서 남･북 통일 후 안게 될 책임과 문제점들은 독일의 통일을 이룩한 경험은우리에게 소중한 사례가 될 수 있다. 그럼에도 불구하고 통일 후 북측지역의 교정정책을어떻게 계획하고 실시하여야 할 것인가 보다 구체적으로 북한지역 교정시설의 문제점과 개선방법 교정시설 복구 비용, 북한교도소시설 활용 방법, 북한 교정공무원에 대한재임용 표준, 수용자 재분류, 개별처우를 위한 특별프로그램의 개발, 교도소 신축 시건축 형태, 재임용 탈락자에 대한 행정소송 준비, 교도소시설의 의료지원 방안, 군교도소와 민영교도소 분리 문제 등 수많은 문제들이 많다고 볼 수 있다. 통일 후 북한지역의 교도소정책의 문제는 그간 한국교정학회와 한국교정복지학회, 교정포럼 등에서 많이 다루지 않은 분야이다. 이 분야는 정치 상황이 지나치게 변동적이고 민감한 특별한 분야이기 때문이다. 이제는 동독과 서독 통일 사례등 외국의 사례를 비교하여 진지하게 검토해 보는 것도 학문적으로 의미가 있다고 본다.
Abstract
The integration of politics, economy, culture, social system, and all sectors is important at this point in the 78th year of the division of South and North Korea, but the integration of corrective administration is considered very important for the stability of the country and society after the reunification of the two Koreas. I don’t think the preparation time will be long even if the unification of the two Koreas is virtual over time in 2044, 20 years after political complex circumstances. This can be easily judged by looking at the unified Germany, which is still suffering from deep aftereffects 41 years after the reunification of East and West Germany. The Korean Peninsula cannot completely delete the task of reunification between the two Koreas from the new history of the two Koreas. The German reunification process and the South and North Korea have similar sectors in clearly complex areas, but there are also areas that are wrong. Therefore, the responsibilities and problems faced after the reunification of South and North Korea can be a valuable example for us to experience the unification of Germany. Nevertheless, how to plan and implement correction policies in the North after reunification More specifically, the problems and improvement methods of correctional facilities in North Korea, the cost of restoring correctional facilities in North Korea, how to use correctional facilities in North Korea, the standard for re-employment of correctional officials in North Korea, the reclassification of prisoners, the development of special programs for individual treatment, the construction form when constructing new prisons, the preparation of administrative litigation for those who are eliminated from re-employment, the medical support plan for prison facilities, the separation of military and private prisons can be considered as many problems. www.moj.go.kr ] III. Correction policy direction in North Korea after reunification - Ministry of Justice. The issue of prison policy in North Korea after reunification is an area that has not been covered much by the Korean Society of Correctional Services, the Korean Society of Correctional Welfare, and the Correctional Forum. This is because this field is a special field where the political situation is excessively fluctuating and sensitive. Now, it is also academically meaningful to compare and seriously review foreign cases such as East and West German unification cases.
