본 연구는 최근 10년간의 아동⋅청소년의 성범죄사건 판결문을 통해 그루밍 성범죄의 요소가 드러나는지를 분석하고 시사점을 도출하여 향후 개선책을 모색하고자 하였다. 이를 위해 아동⋅청소년 성범죄사건으로 형이 확정된 총 117건의 사건들 중 판결문의 내용분석이 가능한 7건을 최종적으로 선정하여 분석하였다. 분석결과 첫째, 판례 7건 모두 그루밍의 단계가 가진 특성을 3가지 이상 가지고 있었다. 둘째, 판례 7건에서 ‘범죄의 지속성’, ‘비밀 유지’, ‘제3자의 의한 신고’가 공통적으로 도출되었다. 셋째, 판례 속 피해자의 공통된 특징은 모두 취약한 환경에 놓인 아동·청소년이었다. 위 연구결과를 통해 도출된 시사점은 다음과 같다. 아동청소년 대상 성범죄자 처벌의 감형사유를 적용하면 안 되며, 신고의무제도를 확대 및 실시해야한다. 관련기관 종사자와 관계자 등을 대상으로 그루밍 성범죄에 대한 예방교육을 지속적으로 진행해야 한다. 취약계층 아동 청소년을 위한 보호체계의 보완이 필요하다. 또한 지원체계에 있어서도 다른 방식으로 접근해야 한다. 마지막으로 성적 동의 연령을 상향하는 방안을 고려해봐야 한다.
Abstract
This study analyzed grooming stages through precedents related to children and adolescents sex offences in the last 10 years. And proposed the relevant implications in order to contribute to establish measures for prevention. For the research, 117 sexual crimes against children and adolescents sentenced by the Supreme Court were collected and finally 7 cases were selected. According to the result of this study, first, at least 3 or more traits of sexual grooming stages revealed in each 7 cases. Second, 3 factors were extracted from the 7 cases; ‘Continuity of crime’, ‘Confidentiality’, ‘Declaration by the 3rd party’. Third, common features of victims were vulnerable and disadvantaged children and adolescents. Findings of this study suggests followings. The commutation for the child molesters should not be applied when sentenced in the Supreme court. Reporting duty system of sexual crime should be expanded as well. A delivery program and a prevention program about the stages of sexual grooming highly needed to carry out constantly for authorities and workers in related organizations. The protection system for adolescents in vulnerable environment should be supplemented in order to prevent sexual grooming abuse. The intervention of experts is also needed to support young victims.
