국가 안전관리 기능강화 방안 연구

본 연구의 목적은 국가의 안전관리의 문제점을 해소하고 보다 효율적인 기능 강화를 위하여 법제도의 분석을 통하여 새로운 차원의 비전을 제시하고, 현재 해당부처에서 자체적으로 수행하고 있는 안전관리업무를 별도의 독립된 정부기구에서 통합수행 위한 컨트롤 타워형의 제도적 방안 설정에 있다. 재난분야 사업부문별 해당 법령에 따른 안전관리 실태 사례조사 및 문제점 검토 결과 총 141개의 사업 중에서 시설물(15) 및 산업(11) 등이 생활(3), 재난(3) 및 소방(3) 등에 비하여 3-5배 이상의 법령의 빈도를 더하고 있다는 것은 개발도상국에서 형성될 수 있는 안전사고의 불감증의 예이다. 한편, 부처별 안전관련 법령의 현황에서는 15개의 사업으로 분류하여 본 결과 12개 이상의 법제도 보유 기관으로서는 국토교통부(21), 산업통상자원부(17), 소방방재청(16) 및 안전행정부(14) 순으로서 전체의 55%에 해당되며, 7개 이하인 그 외의 부처인 해양수산부(7), 고용노동부(6) 및 교육부(6)에서는 45%의 법제도 제정 현황으로서 선진국형 재난안전관련 법제도의 제정으로 변화되고 있는 현상으로 추론할 수 있다. 이러한 문제는 관련 법체계 및 업무의 분산, 총괄조정기능이 미흡함으로 타 법률과의 법적 권한 및 책임의 명확한 정의가 부족할 뿐만 아니라 안전관리책임기관 간 통합 활용을 위한 법·제도 정비로 독립형의 컨트롤 타워의 설정에 의한 안전관리시스템 구축이 필요하다.
Abstract
Purpose of the this study concentrates to generate a new dimensional vision through the solve of the national safety management problems and more effective functional enhancement by law and regulation analysis. The results of the safety management survey and a result of the problems analysis display total 141 business models. The examples of the safety ignoring and the underdeveloped country matter due the fact that lives(3), disasters(3) and fire fighters(3) are 3-5 times less legalistic activities than that of the facilities(15) and industries(11). On the other hand, the results of the safety related laws show 15 categories of the law and regulation events. Over 12 businesses occupy as 55% as Ministry of Land(21), Ministry of Infrastructure and Transport(17), Ministry of Trade, Industry and Energy(17), National Emergency Management Agency(16). A lower of the 7 law and regulation events includes Ministry of Security and Public Administration(14), Ministry of Oceans and Fisheries(7), Ministry of Employment, Labor Reserved(6), Ministry of Education(6). The inference of the alteration on the law and regulation generates from the semi-developed country to the forefront nation. This problem results in not only distribution of works and related law systems, a lack of the total control function results in a precise definition and law authority of the foreign laws, but also the safety management implementation through the set the independent control tower up for the integration and usages between safety management duty corporations of the law and regulation regenerations.
