Abstract

Disaster, whether of natural origin or human-driven, is situated at the center of structural violence, a term that Johan Galtung invented. In disaster, minorities and disadvantaged groups become further vulnerable to hazards, and the existing social inequality further deteriorates. Simply because disaster is not caused by direct violence, the protection of disaster victims under non-democratic states has not become an agenda item of the discussion about responsibility to protect (R2P) in the last decade. There exists no comprehensive international law or norm that may facilitate humanitarian interventions to protect those disaster victims. Under this circumstance, state sovereignty frequently helps worsen structural violence in non-democratic states. State sovereignty may either prevent international humanitarian assistance to the people in desperate need, as shown in the case of the military regime in Myanmar in 2008, or further alienate minorities from relief aid, as seen in the case of Sri Lanka in 2004 amid the internal war. This article underscores the importance of the establishing of disaster governance that is balanced between the respect of state sovereignty and the international humanitarian intervention.
