국제사회는 세계관광기구(UNWTO: Untied Nation World Tourism Organization)를 중심으로 개인의 장애 여부와 관계없이 공정하게 관광할 권리를 보장하기 위해 지속적으로 노력해왔다. 장애 패러다임이 사회적 모델로 전환되면서 관광 분야에서 역시 장애인 관광향유권을 향상하고자 하였으며, 이는 최근 채택된 ‘모두를 위한 관광: 보편적 접근성 증진(Tourism for All – Promoting Universal Accessibility)’의 개념에 잘 나타난다. 본 연구는 국내 관광 관련 법듀들이 이러한 국제사회의 의지를 반영해야한다고 보고, 장애인 관광향유권 향상을 위해 변화한 과정을 고찰하여 통합적 발전방향을 제언하는 것을 목적으로 한다. 따라서 본 연구는 관광 분야의 국내·외 학술자료들과 국내 관광정책의 장애인 관광향유권 관련 논점을 고찰하고 ‘모두를 위한 관광’에서 함의한 관광환경의 보편성과 관광활동 선택의 보편성을 분석 틀로 제출하였다. 또한 국내 관광법규들에서 장애인 관광향유권에 관해 언급한 내용을 모두 조사하여 ‘모두를 위한 관광’의 의미를 반영하는 정도에 대해 분석하였다. 분석 결과로 관광진흥법 및 관광진흥법 시행령의 6개 조항, 관광진흥개발기금법의 1개 조항, 한국관광공사법의 1개 조항과 국내 시·군·구 조례 및 시·도 조례로 19개 지방자치단체의 19개 자치법규에 나타난 장애인 관광향유권에 대한 관점을 제시하였다. 따라서 본 연구는 연구결과를 토대로 관광기본법의 보편성 천명과 관광진흥법의 사회적 인식변화 속도와 방향을 충분히 반영하는 개정에 대해 제안하였다. 이러한 연구 성과를 바탕으로 관광향유권의 형평성 가치 실현의 법적 근거를 마련하고, 장애와 장애인 관광객에 대한 재해석을 공론화하여 국내 관광학계의 편견 해소에 일조하기를 기대한다.
Abstract
Lim, Jee-Eun The purpose of this study is to suggest an integrated development direction by considering the changed process to improve the right to enjoy tourism for the disabled, believing that domestic tourism-related legal systems should reflect the will of the international community. Therefore, this study examined the process of pursuing "tourism for all" in terms of the universality of the tourism environment and the universality of tourism activity choices in the process of changing domestic and foreign academic data and domestic tourism policies. In addition, all of the contents mentioned in domestic tourism laws on the right to enjoy tourism for the disabled were investigated and analyzed to the extent to which the meaning of "tourism for all" was reflected. As a result of the analysis, six provisions of the Tourism Promotion Act and the Tourism Promotion Act, one provision of the Tourism Promotion Development Fund Act, one provision of the Korea Tourism Organization Act, and 19 municipal ordinances of 19 local governments were presented.
