최근에 중국에서 승소하였는데 집행 대금을 돌려받지 못하는 케이스가 흔히 보인다. 경영난에 처한 기업에 대한 채권 회수는 매우 어려운 과제 중의 하나이다. 특히 최근 들어 코로나 19의 영향으로 기업들의 부도 건수가 계속 치솟아 안타까움을 사고 있다. 중국인민법원 공고 사이트에 따르면 2020년 5월 1일부터 5월 24일까지 600개에 가까운 기업이 파산 공고를 냈으며 하루 평균 25개 기업이 파산했다. 그렇다면 파산 직전이거나 이미 부도난 중국기업의 채권을 채권자가 어떻게 회수할 것인가? 본 논문은 주주에 대한 채권 청구, 부채출자전환, 기업파산 신청과 채권 신고의 세 가지 측면에서 경영난에 처한 기업의 채권을 어떻게 회수할 것인지에 대하여 검토하고자 한다.
Abstract
It is common to see the case that have won the case, but nothing has repaided recently. Get the repaidment from the company which is in trouble is one of the most difficult tasks. In particular, because of the Corona 19 the number of firm that goes broke is growing very fast. According to the China People's Court announcement website, from May 1 to May 24, 2020, nearly 600 companies filed for bankruptcy, and on average 25 companies went bankrupt one day. So how do creditors recover the money from the company that is on the verge of bankruptcy or have already went broken? This paper discusses how to recover the money from the Chinese companies which are in trouble in three aspects: recover from the shareholders, debt-for-equity, application for bankrupt, declaration of credits.
