국회의 결산 심의 및 감사권에 관한 연구:주요국 입법례 분석을 중심으로

초록

본 논문의 목적은 의회의 결산 심의 및 감사권에 관한 영국, 미국, 독일, 프랑스 및 일본 등 주요 5개국 입법례 분석을 통해 결산 심의 및 감사권 관련 헌법개정안을 제시함으로써 헌법 개정 논의에 기여하는 것이다. 헌법에 감사원의 국회 지원을 담보하도록 감사원을 국회 소속으로 하고, 감사원을 독립기관화할 경우 국회의 감사요구권과 감사원의 국회 재정통제 지원 의무를 규정하며 감사원의 기능에서 직무감찰기능을 분리할 필요가 있다. 또한 정부의 결산 국회 제출을 의무화하고 국회의 결산승인제도를 규정하며, 국회의 국가채무 통제를 위하여 신규차입 없는 재정균형의 원칙과 국가채무 제한제도를 규정할 필요가 있다. 특히 미국 의회에서 본회의의 결산승인 절차는 없으나 GAO의 지원을 받는 위원회 조사청문회 등을 통한 연중 상시 결산심사제도를 갖고 있다고 보는 근거를 제시한다. 이 같은 개정안은 재정민주주의를 공고화하고 재정건전화에 기여하며 국회의 예결산 심의권 및 감사권을 강화하여 대통령의 권한 분산과 국회의 재정통제권 강화라는 헌법 개정 취지에 부합할 것으로 기대된다.

Abstract

The main research interest of this paper is to suggest an amendment to the Constitution of the Republic of Korea through the case study of UK, US, France, Germany and Japan. This paper makes four policy recommendations to increase the powers of the Korean National Assembly to grant discharge to the government and to oversee the government. Firstly, the Constitution should stipulate that the Board of Audit and Inspection should belong to the National Assembly. This is because the National Assembly can strengthen its oversight power by establishing its own support agency. Secondly, the Constitution should stipulate that the Board of Audit and Inspection should assist the National Assembly and report its audit findings to National Assembly when requested by the National Assembly. Thirdly, the Constitution should stipulate that the National Assembly has the power to grant discharge to the government by the majority of the plenary. Finally, a binding fiscal rule and budget enforcement procedure should be adopted in the Constitution in order to strengthen the power of the National Assembly to control the national debt.
