미국과 영국의 다인종 다문화 수형자의 언어적 지원과 정책적 함의

초록

본 연구는 미국과 영국에서 실시하는 다인종 다문화 수형자를 위한 지원 정책, 특히 언어적 지원 정책을 고찰하고 이를 한국에서 활용할 수 있는 정책적 방안을 모색하는 데에 목적이 있다. 논의의 배경으로 언어적 권리의 개념과 UN과 유럽 연합의 수형자의 권리 규정 중 언어적 권리를 규정한 부분을 살피고 이러한 권리 규정이 미국과 영국 사례에서 어떠한 모습으로 정책적으로 반영되고 있는지 검토하였다. 미국과 영국에서는 행정명령이나 규정으로서 다인종 다문화 수형자를 위한 언어적 지원과 교육적 지원에 대해 명시하고 있다. 아울러, 다인종 다문화 수형자들의 언어적 취약점을 파악하고 적절한 대응을 하고 있으며, 언어적으로 소통되지 않는 다인종 다문화 수형자들이 완전히 고립되지 않도록 적절한 통번역 및 모국어 자료의 제공, 영어 교육의 실시 등 적절한 조치를 취하고 있다. 미국과 영국의 정책은 한국의 다인종 다문화 수형자들이 증가하는 상황에서 맞춤형 한국어 교육과 모어 지원 서비스 강화의 필요성을 시사하고 있으며 구체적이고도 실천적인 적용 방안도 모색해 볼 기회를 제공하였다는 데 그 의의가 있다.

Abstract

The purpose of this study is to discover applicable policies to support the linguistic rights of ethnocultural prison inmates in South Korea. We review prisoners’ linguistic rights as stipulated by the United Nations and European Union as well as how these rights are reflected policy-wise in the United States and United Kingdom. In these two nations, clear administrative orders or regulations require linguistic and educational support for imprisoned linguistic minorities. In addition, linguistic minorities are identified and appropriate measures are taken, such as providing them with native language interpretation and English education to prevent complete isolation. The study is meaningful in that the examined linguistic support policies show concrete and practical methods that South Korea can apply to provide stronger customized Korean language education services and better native language support at a time when the number of ethnocultural prison inmates in South Korea is increasing.
