Abstract
This paper makes comprehensive research with regard to the Vexatious Litigation Acts in the Anglo-American legal system as an effective countermeasure against vexatious litigants, and considers the possibility of introducing similar statutes in Korea. It appears feasible to formulate a countermeasure unique to the Korean system by synthesizing all the advantages of various countermeasures against vexatious litigations culled from the Anglo-American legal system. The following is a summary. First, the Vexatious Action Act was enacted in England in 1896 as the first statute to cope with litigants who institute a litigation habitually, persistently without any reasonable ground. Civil proceedings order is stipulated in the Act, which prohibits any institution of litigation by vexatious litigants without court’s permission. In addition, by amending the Civil Procedure Rule, England adopted three kinds of civil restraint order, i.e. limited civil restraint order, extended civil restraint order, and general civil restraint order in 2004. This new rule covers diverse types of vexatious litigations and allows for flexibility in responding to different degrees of vexatiousness of litigants. Second, in the U.S, the 1963 enactment of the Vexatious Litigant Statute in the state of California was consecutively followed by corresponding state laws in Texas, Ohio, Hawaii, and Florida. The Statute provides for a prefiling order prohibiting a vexatious litigant from filing any litigation in propria persona without obtaining a court order permitting the filing, as well as an order requiring a vexatious litigant to furnish security, thereby allowing for an aggressive countermeasure against vexatious litigations. In addition, the Federal Rules of Civil Procedure Rule 11 lays out the grounds against vexatious litigations. Third, in Australia, the state of Victoria enacted the Vexatious Proceedings Act in 2014, which subdivides the litigation restraint order into limited litigation restraint order, extended litigation restraint order, and general litigation restraint order, and institutes new orders, such as acting in concert order and appeal restriction order. In conclusion, based upon the comparative research on countermeasures against vexatious litigants and their positive effects, this article proposes that Korea positively consider introducing a version of its own. It would be reasonable for the Korean version of the statute to: (a) regulate vexatious litigations on a gradated system, ranging from limited litigation restraint order, to extended litigation restraint order, and to general litigation restraint order, as is the case with England and Australia; (b) define vexatious litigants by adopting numeric approach; (c) confer the right of motion for litigation restraint order upon the defendant of a vexatious lawsuit; and (d) introduce the order requiring a vexatious litigant to furnish security, as in the case of the U.S.
