Abstract

In Korea, the number of asylum seekers is rapidly increasing and a considerable percentage of the requests is grounded on persecution by non-state actors. However, in domestic literature, this topic is only briefly addressed and recent trends in international standards are not properly reflected. This paper examines the international standards regarding persecution by non-state actors and analyzes recent judgments rendered by Korean courts. Whether persecution by non-state actors should be regarded as persecution under the Refugee Convention can be viewed from two perspectives, i.e., the accountability theory and the protection theory. According to the accountability theory, given that persecution means persecution ‘by the state’ in principle, persecution ought to be acknowledged only when the accountability of an act committed by a non-state actor is attributable to a state. On the contrary, the protection theory is of the position that persecution should be acknowledged regardless of whether a state is attributable when a state cannot protect citizens from persecution by non-state actors. Prior to 2004, civil law jurisdictions favored the accountability theory while common law jurisdictions leaned toward the protection theory. However, since the enactment of the European Union’s Qualification Directive in 2004, most refugee-accepting countries have adopted the protection theory. Analysis of recent judgments rendered by lower courts in Korea shed light on the following: (i) Several precedents stated “condonement or tolerance” by a government with respect to acts committed by non-state actors as a prerequisite for recognition of persecution; however, such precedents are based on an outdated version of the accountability theory that is no longer universally applicable and, thus, ineffective. (ii) Certain precedents appeared to have readily acknowledged persecution by non-state actors without careful examination of whether refugees could be protected by the country of origin or whether refugees could emigrate to another region of the country of origin (internal protection alternative). Such attitude of the lower courts should be reconsidered because there leaves room to doubt the judiciary’s knowledge on refugee law and may lead to misconception that the courts are hearing refugee cases with prejudgment.
