특허출원 및 심사 단계에서 출원인과 심사관이 조사한 선행기술문헌은 각각 출원인 인용과 심사관 인용으로 구분되어 특허공보에 기재된다. 본 논문은 1)한국 특허의 인용자료를 최초로 이용해 출원인 인용과 심사관 인용의 영향요인을 분석한 논문으로서의 가치를 갖는다. 본 논문은 2)출원인 인용과 심사관 인용에 영향을 미치는 요인들의 크기나 방향을 두 인용 사이에 비교한다. 심사관 인용이나 출원인 인용이 없는 경우를 제외하면 영향요인의 방향성이나 유의도 측면에서 두 인용간에 상당히 유사함을 발견했다. 이는 출원인 인용 또는 심사관 인용이 별개의 것이 아님을 시사하는 것이다. 본 연구는 3)예비적 성격의 연구(a pilot study) 로서 인용과 영향요인간의 인과관계를 밝히기 보다는 현상을 발견하는 데 초점을 둔다. 향후 과제로 좀 더 많은 연도를 대상으로(출원 cohort별로) 인용자료를 확보한 후, 주요 변수와 관련하여 가설을 설정하고 엄밀한 모형으로 검증하는 작업이 필요하다.
Abstract
Prior arts searched by inventors, and patent examiners appear in the front pages of issued patent documents, in which cited references by examiners are indicated with asterisks. This paper contributes to the literature as a starting point for citation analysis using Korean patent data. The paper investigates determinants of examiner citations as well as applicant citations. The paper finds that considerable differences in the determinants between both citations are faded away if we exclude patents with no examiner-inserted citations in the regression of determinants for the inventor citations, and with no applicant citations in the regression for the examiner citations. The finding implies that both citations are interconnected in some way rather determined separately. This paper is a pilot study with a limited period of data. Further studies equipped with longer-period data, and enhanced methodologies are needed to be conclusive about the existence of differences in the determinants of citations and to provide the explanation for the causality between inventor/examiner citations and their determinants.
