루부탱社의 레드솔 단일색채 상표 인정여부에 대한 고찰 : 2012년의 미연방 제2순회항소법원 판결을 중심으로

프랑스의 명품 구두 브랜드 “Christian Louboutin”은 브랜드의 상징이 된레드솔의 빨간색 독점을 위한 전쟁을 치르고 있다. 본고에서는 Yves Saint Laurent과의 상표침해 분쟁을 다루었던 2012년의 미연방 제2순회항소법원판결을 중심으로 레드솔의 상표권 인정이 타당한지에 대해 조명하였다. 당시 루부탱 법정에서의 쟁점은 레드솔의 미적 기능성 존부와 단일색채가 패션업계에서 상표가 될 수 있는지에 대한 판단이었다. 피고 YSL은 항변의 논거로서 미적 기능성 원리, 색조혼동론, 그리고 색채고갈론을 제시하였다. 법정에서 부인되었던 이 이론들을 재검토한 결과로서 본고에서는, 1) 레드솔에 미적 기능성이 인정되며, 2) 레드솔의 빨간색을 소통함에 있어서 혼동가능성이 있고, 3) 레드솔의 단일색채 상표권을 인정하는 경우에 빨간색은 고갈될 것이라는 주장을 전개하고 있다. 레드솔의 상표 적격 여부 분석의 복잡성은 그 표장이 적용되는 상품이 패션제품이라는 점과 패션제품에서 색상은제품을 구성하는 디자인 요소라는 점에 있다. 단일색채의 상표성에 관한 문제는, 표장이 사용되는 지정상품 및 서비스가 속한 업계의 특성을 고려하여판단되어야 할 것이다. 향후 단일색채 상표의 출원등록에 대한 관심과 상표적격에 대한 논쟁이 다양한 산업분야로부터 제기될 것으로 예측되는바, 국내에서는 관련 판례가 집적되지 않은 상황에서 선행된 외국의 사례를 검토하는 것은 유의미한 시도가 될 것이다.
Abstract
Christian Louboutin has maintained its reputation as a high-end luxury fashion icon with its signature of the Red Sole Mark but also has been in litigation over the monopoly of using the color red. The case of litigation with its archrival Yves Saint Laurent over the trademark infringement at the United States Court of Appeals for the Second Circuit in 2012 made the headlines all over the world. Some of the key legal issues at the Second Circuit included: 1) whether a single color can translate into a trademark in the fashion industry and 2) whether the aesthetic functionality of the Red Sole can be found. YSL, the defendant at that time, suggested the three arguments as its counter-arguments: the principle of aesthetic functionality: the shade confusion rule; and the color depletion rule. This paper suggests the following three questions for research and reilluminates the above-mentioned principles dismissed at the 2012 court. First, can we find aesthetic functionality from the Red Sole? Second, is there any confusion in terms of communication among colors? Third, can the Louboutin's red color be depleted?
