전통지식에 관한 국제기구 논의 비교 연구 : WG8j와 WIPO/IGC를 중심으로

2017년부터 국내에서도 나고야의정서가 발효되면서 나고야의정서의 적용대상인 유전자원 보호와 접근, 그리고 이익 공유에 대한 논의가 활발하게진행되고 있다. 현재 전통지식 보호와 이익 공유에 대한 논의는 유엔환경계획의 생물다양성협약과 세계지식재산권기구와 같은 국제기구를 통해 진행되고 있다. 생물다양성협약 제8조 j항에 규정된 전통지식의 존중, 보전, 이익 공유의권장에 대한 내용으로 인해 전통지식 보호 논의가 시작되었고, 이를 구체적으로 실현하는 방안은 두 가지 방향에서 진행 중이다. 그중에서 하나는 WG8j를 구성하여 이익 공유의 실효성을 높이기 위한 방안을 마련하는 것이고, 다른 하나는 세계지식재산권기구 정부간위원회에서마련하는 협상문안을 통해 전통지식보호에 관한 협상을 체결하는 것이다. 본 연구에서는 WG8j와 WIPO/IGC에서 진행되고 있는 전통지식 관련 논의의 결과물인 자발적 지침과 전통지식협상문안의 구체적 내용을 살펴보고, 두 국제기구에서 진행되고 있는 논의 방향에 대한 비교를 수행한다. 아울러두 국제기구에서 도출된 결과물에 대한 검토를 통해 국내 전통지식의 보호와 해외 전통지식의 접근과 이용을 위한 방안을 제시한다.
Abstract
As the Nagoya Protocol has taken into effect in Republic of Korea since 2017, discussions on the protection, access, and benefit-sharing of genetic resources and traditional knowledge associated with genetic resources that are the subject of the Nagoya Protocol has been actively conducted. At present, discussions on the protection of traditional knowledge and benefit-sharing are being conducted through international organizations such as the UN Convention on Biodiversity and the World Intellectual Property Organization. The discussion on protection of traditional knowledge has begun because of the recommendation of respect, preservation and benefitsharing of traditional knowledge as set out in Article 8 (j) of the Convention on Biological Diversity. One of them is to form a WG8j to improve the effectiveness of benefit-sharing, and the other is to negotiate ‘The protection of traditional knowledge’ at the World Intellectual Property Organization. This study examines the contents of voluntary guidelines and traditional knowledge negotiations, which are the results of discussions on traditional knowledge at WG8j and WIPO / IGC, and compares the directions of discussions at the two international organizations. The results of the two international organizations are reviewed to suggest the ways to protect domestic traditional knowledge and to access and use foreign traditional knowledge.
