고령화 사회 진입을 향한 제약특허 존속기간 연장제도 개선에 관한 법적 연구

21대 국회임기 만료로 폐기된 바 있었으나 뜨거운 감자로 논의되었던 “제약특허 존속기간연장제도를변경하기 위한 특허법 개정안”(정일영 의원 대표발의, 의안번호 제2121189호)은반드시 지난 국회에서처리되었어야 할 필수 입법이었다고 생각된다. 특히 최근 졸겐스마와 같은 혁신 신약 앞에 개발에 대한 기쁨도 잠시일 뿐이고 제약특허 존속기간 연장에 따른 장기간 고가의 신약 가격 앞에 환자와 환자의 가족들은 그림의 떡이나 다름없는 상황에 직면하게 된다. 이와 같이 제약산업의 특수성을 인정받아규정되어온 “제약특허 존속기간 연장제도”가 ‘생명’ 이라는 근본적 가치보다 앞설만한 가치가 있는지재검토가 필요한 시점이 아닌가 생각된다. 우리나라는 현재 의료보험 누적적자로 개혁이 불가피한 상황에 놓여 있고 2023년 고령화 인구 950만진입 시대에 국민의 생활과 가장 밀접한 관계를 맺고 있는 의약품의 가격은 특허제도와 무관하지 않으며, “제약특허 존속기간 연장제도”는 의료보험 제도의 국가부담과 직접적인 인과관계가 있다. 이와 관련하여 연장된 제약특허의 최장 존속기간에 대하여 미국과 중국은 14면, 유럽은 15년을 초과할 수 없다는 최장 한도의 제한 규정을 두고 있지만 우리나라 현행 특허법에는 이와 같은 연장된 존속기간의 최장 한도제한 규정이 없기 때문에 값싼 제네릭 의약품(바이오시밀러)이 원활하게 공급되지못한다는 문제점이 있다. 이러한 문제점을 해결하여 국민건강의 증진을 촉진하고 우리나라 제약사의 이익도 함께 도모할 수 있는 글로벌 수준의 존속기간연장제도의 개선이 필요하다. 특히 고령화 사회와 의료보험 누적적자를 감안하여 국가가 보전할 수 있는 의약단가가 설정될 수 있도록 캐나다의 의약품 단가보호제도와 일본의약가결정제도에서 시사점을 바탕으로 (ⅰ) 연장된 존속기간의 최장 한도제한 규정의 도입, (ⅱ) ‘식약처장의 승인을 얻어 실시한 임상시험기간’의 전체기간이 아니라 특정 제한조건 하에의 산정(미국과 같이임상시험기간의 1/2) 기준의 도입, (ⅲ) 존속기간 연장된 특허권의 효력범위를 미국과 같이 ‘유효성분’ 으로 한다는 한정 규정의 도입을 적극 검토할 필요가 있다.
Abstract
The Republic of Korea is currently in a situation where reform is inevitable due to the cumulative deficit in medical insurance, and in an era where the aging population will reach 9.5 million in 2023, the prices of medicines that are most closely related to people's lives are not unrelated to the patent system, and the “duration period of pharmaceutical patents” The “extension system” has a direct causal relationship with the national burden of the medical insurance system. In this paper, we examine the current problems of the “pharmaceutical patent duration extension system” and suggest ways to improve the system as a change, while also proposing a system in the direction of protecting the interests of domestic pharmaceutical companies and maintaining the legal system at a global level.
