최근에 이뤄진 노인학대실태 조사에 의하면, 우리 나라 노인의 5.1%는 노인복지법상 처벌조항이있는 노인 학대를 당하고 있는 것으로 추정되고 있다. 정부는 지난 2004년 노인복지법을 개정을 통해서 가정과 노인요양기관 등에서 감춰져 온 노인학대 피해를 드러내기 위한 법적 제도적 개선을 이뤘다. 이에 따라 노인학대 관련 직종 종사자에게신고의무를 부여하고, 노인보호 전문기관을 통하여노인학대 피해자 보호를 위한 교육 및 홍보, 사후보호조치 서비스를 제공하고 있다. 그럼에도 불구하고 노인학대 피해 신고율은 실제 발생율과 비교하면지극히 미미한 실정이고 여전히 대다수의 노인학대피해는 관련 기관에 보고되지 않은 채 감춰져 오고있다. 이 글은 학대 피해 노인에 대한 정부의 공적보호서비스가 제대로 이뤄지기 위해서는 먼저 노인학대 피해가 신고되고 드러나야 한다는 문제의식에서 노인학대 피해 신고율을 높이고 조기 발견을 위한 대책을 모색하는 데 목적이 있다. 이 글에서는노인학대 피해 신고율을 높이기 위해서 현 노인복지법에 따른 노인학대 신고의무제도의 개선 대책을 제안하고 있으며 노인학대 피해 조기 발견을 위한 제도적 개선과 더불어 노인보호전문기관 및 경찰의 적극적인 역할을 제안하고 있다.
Abstract
Elder abuse is one of the serious social problems that Korean older persons are facing. However, only recently social concerns have been raised about elder abuse and policy measures taken to prevent elder abuse. A new survey found that more than 200,000 elderly person, or 5.1percent, are estimated to be facing elder abuse in the narrow sense of the word that prohibited in the “Welfare for elderly people Acts”. But the number of reported abuse are just few. The majority of victims of elder abuse lay hidden in social ignorance. Through change in the “Welfare for elderly people Acts” in 2004,institutional improvement of reporting system has been already achieved,including mandatory reporting of elder abuse. But report ratio of elder abuse by person who have duty to report is very low. The reporting system still need a lot of corrections. The purpose of this study is to take countermeasures to enhance the report ratio and to detect older abuse early. First, this study focusing on mandatory reporting of elder abuse, suggest several institutional improvement. also, this study consider a measures to detect older abuse early, along with a role of police officers to protect elder abuse. To reduce elder abuse, police officers as well as social welfare organs should take a profound interest in the problems of the aged.
