Abstract
In this paper, we examined the legal nature of police wearable police cameras as forced disposition, and examined the possibility of warrant exception for the use of wearable police cams. Currently, police not only ensure the legality of police officers' enforcement, but also enforce the rules for the operation of the wearable police cam system (hereinafter referred to as the “rules of operation”) in order to curb interference with police execution. However, the normative discussion of such wearable police cams has not yet been fully implemented. The first problem is that the legal nature of the wearable police cams and the judicial control over them are not realized. Secondly, according to police operating rules, the police are required to:1) make a compulsory personal punishment; 2) be necessary for criminal investigation; i) during or immediately before or after the crime; and ii) Wearable polis cams can be used if all of these conditions are satisfied. This can be interpreted as a preliminary attempt to recognize a warrant exception to the use of a wearable police cams, but it is inevitable that the provisions of Article 216 and 217 of the Criminal Procedure Act. The second problem is that it is necessary to check whether it can be included in the regulation. This awareness is based on the fact that police officers are using not only the shooting devices currently being piloted but also the wearable police cams, It will be in line with police demand that it needs to respond to the controversy in advance. As a result of the research, it was confirmed that, in principle, a warrant issued prior to the shooting was required because it was forcedly dismissed if it was photographed with a wearable police cam without the consent of the parties. However, the use of wearable police cams with pre-warranted warranties must be acknowledged as warranted because the characteristics of wearable police cams are very inefficient. The problem is that Article 6 of the rules of operation, which opened up the possibility of such exceptional recognition, proves that it is difficult for the Criminal Procedure Act to be subject to the exception of the warrant of the forcible disposition. Therefore, if the operation of wearable police cams is to be legitimate, it is confirmed that the personality aspect and the possibility of the Doctrine of Warrants are specified clearly, and efforts to minimize the infringement area of the people are required.
