공해상에서의 마약류 밀매의 경우 해양법과 국제협약 상으로 보편적 관할권의 대상 아니다. 따라서 국제협약에서 제시하고 있는 단속방법을 공해상에서 실시하기는 어려운 점이 있다. 다만 실질적으로 당사국의 안보에 위해가 되는 범죄행위에 대해서 선제적 대응을 할 수 있는 방안을 모색하는 것이 반드시 필요하다. 미국의 경우는 기존의 국제법 관계에서 다소 벗어난 법률을 제정하여 국가의 중대한 위기에 대한 대응이라는 명제하에 계속해서 그내용을 정리하고 있다. 국제법의 틀은 반드시 존중해야 하겠지만 현대사회에서 범죄 형태가 빠르게 변화하는 만큼 새로운 형태의 조약이나 국제관습법이 필요한 시점이며, 이에 미국의 시도를 우리나라에 맞게 적용시킬 방안을 강구해야 할 것이다. 최근 해상에서의 마약류사범의 추세는 단순판매, 사용자에 한하지 않고 국제적인 유통망을 갖추고 마약류를 밀매하는 등 다양한 방법으로 이루어지고 있다. 이에 해상 마약류 밀매수사의 효율화를 위해수사기관의 수사체계 및 장비, 인력 등의 보강이 필요하다. 그리고 마약류 수사기관과 정보기관간 협력의 지속적 확대가 요구되며, 자금원의 위장행위를 단속하기 위해 민간부문의 각급 금융기관을 비롯한 여러 유관기관들과 긴밀한 협력관계를 유지하여 지능적인 범행 기도에 대처해야 할 것이다. 또한 우리나라와 인접한 국가와의 형사사법공조를 확대하여 해상에서의 마약밀매에 대처해야 할 것이다.
Abstract
In the case of Korea, despite its nickname as the Clean Drug Administration, drug that can be administered to 1 million people were recently discovered by foreign ships that entered Busan Port. In particular, drug trafficking in the high seas is not subject to universal jurisdiction under maritime lawand international conventions. Therefore, it is difficult to implement the enforcement method suggested in the international convention on the high seas. However, it is absolutely necessary to find a way to take a preemptive response to criminal acts that actually endanger the security of the State party. In the case of the United States, laws that deviate somewhat from the existing international legal relations have been enacted and the contents are continuously arranged under the premise of responding to a major national crisis. Although the framework of international law must be respected, a new type of treaty or customary international law is needed as crime patterns are rapidly changing in modern society. The recent trend of drug offenders at sea is not limited to simple sales and users, but is carried out in various ways, such as drug smuggling with an international distribution network. Therefore, it is necessary to reinforce the investigation system, equipment, and manpower of the investigation agency to improve the efficiency of maritime drug trafficking investigations. In addition, continuous expansion of cooperation between drug investigation agencies such as police, maritime police, prosecutors, customs, and other drug investigation agencies and intelligence agencies is required. It will have to cope with intelligent criminal intentions by maintaining it. In addition, cooperation in criminal justice with Korea and neighboring countries should be expanded to deal with drug trafficking at sea.
