한국형 진술 신빙성 평가 모델(K-SCAM) 제안 및 타당성 검증

초록

이 연구는 진술증거가 수사방향을 결정하는데 중요하게 활용되는 사건에서 적용 가능한 새로운 진술분석 기법을 제안한다. 현재 수사현장에서 활용되는 주요 진술분석 기법은 SCAN, CBCA, RM 기법이 있다. SCAN은 여러 나라의 형사사법기관에서 진술 분석을 위해 가장 일반적으로 활용되는 기법이다. CBCA와 RM도 진술 신빙성 평가를 위한 준거를 제시하고, SVA는 이런 과정을 표준화한 절차이다. 진술분석 기법이 기존의 경험적 평가방식과 비교하였을 때에 비해 효과적이다는 반복된 연구에도 불구하고, 진술분석 결과가 타당한가, 증거로서 활용가능한가 대한 현실적 우려도 여전히 존재한다. 이에 진술분석 결과의 증거능력과 증명력을 확보하고, 실무상 활용성을 확장하는 한국형 진술 신빙성 평가 모델(K-SCAM)을 새로운 진술분석 기법으로 제안한다. K-SCAM은 진술분석 절차를 표준화함과 동시에 신빙성을 평가하는 기준을 제시한다. K-SCAM의 타당성을 검증하기 위해 65건에 진술분석 사례에 대한 수사결과를 추적하였다. 그 결과 63건의 사례(96.9%)가 일치한 것으로 확인되었다. 추후 후속 연구를 통해 신뢰성과 타당성을 확보하는 방향으로 K-SCAM이 수정․보완될 필요가 있다. 더불어 기존의 진술분석 기법과 함께 실체적 진실을 밝히는데 도움이 되는 유용한 기법으로 자리 잡길 기대하여 본다.

Abstract

This study proposes a new statement analysis technique that can be used in criminal cases, where statement evidence has a significant influence on determining the direction of investigation. There are well-known statement analysis techniques in current investigation field: SCAN, CBCA and RM. SCAN is the most worldwide tool for evaluating statement credibility. CBCA or RM also provides criteria for the analysis, and SVA refers to a standardized procedure for statement analysis including CBCA and RM . Despite a number of studies assuring the effectiveness of statement analysis technique compared to other empirical methods, there are still widespread concerns about whether the result of statement analysis is valid, and furthermore can be used as evidence in court. Accordingly, Korean style-statement assessment model (K-SCAM) is designed as a new statement analysis technique to secure admissibility and relevancy and to extend practical use. The K-SCAM standardizes the statement analysis procedure as well as presents criteria for evaluating credibility. To verify the validity of the K-SCAM, the research tracked the investigation result of 65 statement analysis cases. As a result, 63 cases (96.9%) demonstrates consistent. The K-SCAM will be elaborated and advanced its admissibility and relevancy through further research. It is expected K-SCAM to be utilized in criminal justice system as a major investigative technique to reveal the substantive truth.
