Abstract

This study explores how the legal definition and control of citizens evolved over time in the Alsace-Lorraine region, with particular attention to the unique historical and social context of this territory. Following the Franco-Prussian War, Alsace-Lorraine was newly formed and annexed to the German Empire under the pretext of being a region inhabited by the German people, marking the final step in German unification. However, in reality, the region was home to both German-speaking and French-speaking residents, and most of those granted German citizenship accepted the change as an administrative adjustment rather than an expression of national identity. The German authorities also regarded the residents of the annexed territory as German citizens by default, only addressing questions of nationality when specific issues arose. This reflects the incomplete development of the nation-state in the late 19th century and reveals the limitations of state control over individuals during that period. After World War I, when France regained Alsace-Lorraine, the status of its inhabitants changed once again. The experience of war heightened suspicions of espionage by enemy nationals in both France and Germany. Consequently, the French government classified residents as either "former French citizens" or "former enemies" and introduced policies such as a special identity card system to exclude German-speaking residents, while also imposing stricter naturalization requirements for those from enemy nations. However, these administrative measures did not align with the complex realities of life in Alsace-Lorraine, a region where French, German, and various immigrant communities coexisted. The attempt to divide the population into clear categories of "nationals" and "non-nationals" failed to reflect this diversity, resulting in confusion and hardship for many residents. The case of Alsace-Lorraine demonstrates that, although the mechanisms through which nation-states assign legal identity became more structured as nation-states matured, their application remained fluid, influenced by political conditions and administrative practice. In this process, some residents faced discrimination and exclusion. Ultimately, this study argues that the formation of nation-states was not a straightforward or harmonious development, but rather a complex and sometimes contradictory process shaped by multiple, overlapping factors.
