무동기범죄의 실태와 대응방안에 관한 연구

최근 동기가 불분명한 살인이나 성범죄, 폭력 등이 빈번하게 발생하고 있다. 무동기범죄의 개념은 학문적으로 정의하기는 어렵지만 일반적으로 동기가 불분명하고 불특정 다수를 대상으로 하는 살인, 강도, 강간, 방화 등 강력범죄를 말한다. 본논문에서는 무동기범죄의 개념을 범죄자의 범행동기와 목적이 불분명하고 범죄자와 피해자 간에 특정한 이해관계나 상호작용없이 불특정한 사람을 대상으로 한 범죄라고 정의하고자 한다. 특정한 동기가 없거나 확인이 어려운 무동기 범죄는 경제적 양극화, 빈곤, 실업,쾌락, 환상, 폭력적 하위문화 등 사회병리적 현상에 기인한 것으로 판단된다. 무동기범죄는 대체로 자신과 사회에 대한 불만을 자신과 아무런 관계도 없는 불특정인에 대하여 난폭하게 표출하는 ‘화풀이형’, 사회적으로 고립되어있거나 대인관계능력이 결핍되어 있는 외톨이나 은둔자에 의해 저질러지는 ‘외톨이형’의 양상을 띤다. 무동기 범죄의 대응을 위해 외국경찰의 경우 수사와 예방을 위해 강력한 법집행과 아울러 다양한 해결책을 제시하고 있다. 미국의 경우 증오범죄에 대한 법제도적인 면 뿐아니라 법집행적인 면에서도 단호하면서고 강력한 대응을 하고 있었다. 영국도 관련법률의 제정하고 수사와 예방에 다양한 노력을 기울이고 있었다. 한국의경우 현재의 대응방식으로는 많은 한계를 가지고 있다. 전통적인 수사기법으로는 최근의 무동기범죄를 해결하는데 한계가 있다. 무동기범죄에 대응을 위해서는 초동수사체계의 확립, 수사의 전문화와 과학화, 무동기범죄 전문대응팀 등의 신설, 우범자관리체계의 재정립, 협력치안의 확립 등이 필요하다. 이와 아울러 정부와 지방자치단체, 관련기관과 시민단체 등 범정부적인 차원에서 빈곤과 실업, 소외와 차별 등의 문제해결을 위해 다양한 프로그램이 제시되어야할 것이다
Abstract
In these days, the number of crimes is increasing in which specific motive can not be found or identified. Economic class polarization, quickness,hedonism and violence-oriented culture may cause this tendency, in many cases this kind of crimes take the shape of serials. Conventional investigation techniques are not enough to solve the motiveless crimes. The first, to collect correct information for identification of a person accidentally killed, a joint on-the-spot attendance system by spot identification personnel and legal medicine specialist shall be institutionalized. The second, wide area unit investigation must be used and set. Above all,because what the crime of the present time when it sees is becoming wide area and criminals are not limited in the ointment line of the narrow confine, investigation setup in the area police station center of existing must be raised. Therefore it is needed for upgrading the capability of investigation of Korean National Police to systemize and professionalize profilers. It is also required to build up education of detectives on profiling and to substantialize data base on violent crimes.
