노인수용자의 처우 관련 현행법의 한계 및 개정방향에 관한 연구 -국제인권규범과의 비교를 중심으로-

이 연구는 교정시설의 수용자 고령화 추세에 맞춰 유엔 및 유럽연합, 세계보건기구 등이 권장하는 정도의 노인수용자 인권처우규정을 국내법에 반영하도록 관련법의정비방향을 제시하고자 하였다. 한국은 2015년을 기준으로 60대 이상 노인수용자가 전체 수용인구의 9.7%를 차지하여 2010년에 비해 52.5%나 증가하였다. 전체 수용인구 중 50대 이상의 비중은34.2%에 달해 향후 수용인구의 고령화는 더욱 가속화될 것임을 뚜렷하게 예측할 수있다. 국제사회는 수형자 고령화 및 노인수용자의 인권처우를 위한 방안을 다양하게 모색해 왔다. 유엔의 노인을위한유엔원칙, 피구금자최저기준규칙, 그리고 유럽연합의 장기수용자처우권고, 교도소건강관리의윤리및조직권고, 세계보건기구의 노인수용자및만성질환치료권고 등이 대표적인 노인수용자의 인권처우 규범이라고 할 수 있다. 그러나 한국의 형집행법 등은 노인수용자에 대한 특별한 처우규정을 두고 있지 않다. 따라서 국제적 인권규범에 준하는 정도의 노인수용자의 인권적 처우를 위한 관련법의정비방향을 제시할 수 있다. 첫째, 형집행법상 노인수용자 처우규정의 명확화가 필요하다. 둘째, 형집행법상 노인수용자를 배려한 교정시설 및 환경정비 규정의 명문화가 필요하다. 셋째, 형집행법및 의료법상 노인수용자 의료처우 규정의 정비가 필요하다. 넷째, 형법 및 형집행법상 노인수용자에 대한 가석방 조건의 완화가 필요하다. 다섯째, 형집행법상 수용자고령화대책 거버넌스체계를 구축할 수 있는 근거규정이 필요하다.
Abstract
The purpose of this study is to suggest the direction of the revision of relevant laws to reflect the human rights treatment provisions of the elderly detainees recommended by the United Nations, the European Union and the World Health Organization in accordance with the aging population of correctional institutions. As of 2015, over 60 Koreans accounted for 9.7% of the total population. This is an increase of 52.5% compared to 2010. The proportion of the total population over 50 years old is 34.2%, and the aging of the population will accelerate. The international community has searched for human rights treatment for the old prisoners in preparation for the aging population. Representative international human rights norms include the UN Principles for Older People, UN Standard Minimum Rules for the Treatment of Prisoners, EU‘s the recommendation of the treatment of long-term prisoners, recommendation concerning the ethical and organizational aspects of health care in prisons and the older prisoner and complex chronic medical care of the WHO. However, the Korean laws do not have special treatment provisions for the old prisoners. Therefore, i propose to amend current the provisions of the administration and treatment of correctional institution inmates act on the treatment of the old prisoners under reflecting the international human rights level as follows. First, it is necessary to clarify the provisions for the treatment of the old prisoners. Second, it is necessary to clarify the correction facility and the environment maintenance regulations considering the old prisoners. Third, it is necessary to revise the medical treatment law for the old prisoners and the medical treatment provisions for aging prisoners. Fourth, it is necessary to alleviate parole conditions for old prisoners under penal laws and administration and treatment of correctional institution inmates act. Fifth, it is necessary to establish a basis provision for establishing the governance system for the aging population trend of prison.
