선화증권의 위기문제와 전자선화증권의 도입에 관한 연구

오늘날 선박의 고속화, 컨테이너선의 출현으로 선화증권이 물품보다 늦게 도착하여 목적지에서 물품의 인도가 늦어지는 상황이 발생하고 있다. 이러한 상황은 선화증권의 위기라고 언급되고 있다. 선화증권의 위기를 극복하기 위하여 해상운송장, 수입화물선취보증장 등 다양한 방법들이 제시되었지만 그러한 방법들은 기술적 그리고 법률적 문제 때문에 만족스럽지 않다. 전자선화증권은 이러한 선화증권의 한계성을 극복할 수 있다. 서류의 불일치 등으로 인해 발생되는 여러 가지 비용과 시간의 절약, 불확실성과 영업위험을 감소시키기 위해 전자선화증권의 도입은 중요하다. 본 논문의 목적은 선화전권의 위기와 전자선화증권의 도입필요성을 살펴봄으로써 전자선화증권의 도입에 기여하는 것이다.
Abstract
Recently, circumstances have occurred in which bills of lading arrived later than the goods shipped, particularly with the introduction of high-speed cargo vessels, thus resulting in a delay in delivery of the goods at the place of destination. This situation was referred to as the crisis of bill of lading. There are many ways to resolve a 'the crisis of bill of lading' such as Sea Waybill, Letter of Guarantee. They are unsatisfactory because of technical and legal problems. Electronic bill of lading can overcome such limitations of an ordinary bill of lading. To save time and money which is killed by discrepancy in document and to decrease the uncertainty and business risk, the introduction of electronic of bill of lading is very important. The purpose of this paper is contribute to the introduction of electronic bill of lading by understanding the crisis of bill of lading and the necessity of Introduction of electronic of bill of lading.
