Abstract
On 13 December 2018, the Special Act On Designation Of Business Types and Items Suitable for the Living of Micro Enterprise (hereinafter referred to as “The Special Act”) was enacted in order to protect the right to life of micro enterprises and to strive for balanced development of the national economy. The Special Act provides the designation of business types and items suitable for the living of micro enterprise (BTILMe) excluding large enterprises’ involvement (Article 8). In this essay, I explore the goal of antitrust law debate in U.S. and rise and fall of the democratization of the economy concept in Germany. And I evaluate the Special Act from the competition law’s perspective. I insist that the National Assembly’s direct purpose in passing the Monopoly Regulation And Fair Trade Act (hereinafter referred to as “The Fair Trade Act”) -which is a competition lawwas to promote fair and free competition and to prevent excessive concentration of economic power and by so doing to improve consumer welfare in the long run (Article 1). And I am concerned that the BTILMe designated under the Special Act would sometimes result in such consequences of entrance barriers as entailing higher prices, reduced quality, or reduced output that producers could extract surplus from consumers. Those situations might conflict with the Fair Trade Act’s ultimate purpose. For “It is competition, not competitors, which the Act protects.” However, the BTILMe program would be exempted from competition law on the Constitutional ground, to democratize the economy through harmony among the economic agents (Constitution of The Republic of Korea Article 119(2)) and to protect small and medium enterprises (Article 123(3)). I conclude by offering positive policy suggestions that follow from my analysis. I recommend that legislature should amend the Special Act as follows: First, it is necessary to provide that the BTILMe should be designated within minimum degree. Second, the Special Act should allow large enterprises franchisees to enter the market designated as the BTILMe. Third, the BTILMe should be confined to specific retail business, excluding manufacturing industry. Fourth, the Fair Trade Commission should enforce actively the Fair Trade Act to the anticompetitive acts in the market designated as the BTILMe. Last but not the least, the Fair Trade Commission should have the power to require cancellation of a designated BTILMe if it is not necessary any more for circumstantial changes.
