사회가 허용하는 자유와 사적 소유는 사람들이 그로 인한 위해를 감수하기로 합의한 항목에 한한다. 이기적 경제활동이 다른 사람의 사적 소유를 침탈하지 못하도록 고안된 제도가 사유재산권제도다. 부족한 것을 얻으려는 인간 행동은 경쟁으로 표출되는데 시장경제의 경쟁은 재산권을 이전 받으려는 경쟁이고 실체를 먼저 찾는 경쟁이다. 그 과정에서 다른 사람의 재산권을 침탈하지 않아야 공정 경쟁이다. ‘후생경제학의 제1정리’는 외부성이 없을 때 경쟁균형은 자원을 파레토 효율적으로 배분한다고 논증한다. 동태적으로 시장의 상벌기능은 가격조정을 통하여자원과 노력을 사회적으로 모자라는 상품의 생산으로 인도한다. 사람들은 경쟁을통하여 재산권을 취득하고 또 이전하는 데 합의하는데, 자원배분과 소득분배는그 결과다. 시장실패는 재산권보호 실패때문에 일어나는 문제로서 자원배분의 비효율성을 야기할 뿐 아니라 소득분배의 공정성도 왜곡한다. 시장경쟁이 공정하면소득분배도 공정하다. 그러므로 복지혜택은 수혜자의 권리가 아니라 제공자의 배려다.
Abstract
Freedom and ownership are honored if people have agreed to take hazards created therefrom. System of property right is designed to harness human greed to produce more value without invading others’ property right. People compete for owner’s consent to transfer property if the target is already owned by an owner, and to discover, invent or devise new resource, technology and idea which is to be owned by the first mover. The competition is fair if no competitor is intruded upon property rights in the process of competition. First Welfare Theorem supports static efficiency by showing competitive equilibrium allocates resources efficiently under no externality. Prize-penalty function of price system raises(lowers) price to encourage(discourage) production in excess demand(supply) to realize dynamic efficiency. People compete for more income to result in resource allocation and income distribution. Market failure occurs when property rights are unduly violated to make resource allocation inefficient and income distribution unfair. Social welfare benefits are not the right of the beneficiaries but the favor of benefactors under fair competition.
