Abstract

Restrictions on the freedom of art guaranteed in Article 22 paragraph 1 of the Constitution of the Republic of Korea is mainly appeared as the legal notions like ‘obscene’(음란한) acts or pictures. On the one hand, freedom of artistic expression may infringe upon someone's legal interests, especially from the perspective of criminal law. On the other hand, freedom of art can emerge as a defence against the crimes such as insult, defamation or property crimes. Independent of his personal attitude to the freedom or its limitation of artistic creative activities, anyone who needs to resolve the problem of conflicting interests has to answer the following fundamental questions: “what is art?”, “who can define art?” These two questions are being currently subject of intense debate, it is difficult to expect a consistent agreement. In this paper, the author attempts to review the opinions on the proper decision-maker for the legal definition of art and the limitation of creative artistic activities, and to propose a solution to those questions by looking at the relevant discussions in Germany and comparing with domestic discussions in Korea.
