초록

종래의 입법은 물리력을 전제로 어느 정도 정형화된 위험을 대상으로 하는 규제법이었다. 이러한 관계로 현재 진행되고 있는 사물통신시대에 내재된 비물리적이고 정형하기 어려운 고도화된 사이버위협으로부터 개인정보의 보호와 개인정보의 활용간에 ‘Positive-sum’의 결과를 유지할 수 있는 법제의 정비가 시급하다. 특히, 현행법제상 개인정보 유출사건이 발생하더라도, 정보주체인 개인이 정보처리자와 대등한 관계에서 배상책임을 받을 수 있을 것으로 기대하기 어렵다. 즉, 과실에 대한 입증책임이 전환되는 경우라 하더라도 개인의 입장에서는 정보처리자의 불법행위와 자신이 입은 피해간의 상당인과관계의 입증이나 피해액의 입증을 기대할 수 없고, 법정배상의 경우에는 정보처리자의 고의⋅과실 및 해당 불법행위와 자신이 입은 피해간의 상당인과관계 등을 입증할 것으로 기대하기 어려운 것이다. 이와 같이 개인과 개인정보처리자 사이에 존재하는 정보격차(Digital Divide)를 해소하기 위해서는 정보처리자에 대해 “설계에 의한 사생활보호”(Privacy by Design) 책임을 부여하는 한편, ‘구조화된 사이버 위협정보’를 표현하는 ‘STIX’ 제도를 개인정보 보호분야에서도 적극 도입할 필요가 있다.

Abstract

‘Internet of Things(IoT) society’ is not a physically active society but a ‘Cyber-Physical System’ society in which the demands of individuals and society are met in real time by physical systems controlled by non-physical digital data. In these societies, the fulfillment of individual needs without the provision of personal data or the promotion of public welfare can not be assumed. In this regard, the demands of the public and private parties to realize the infinite value inherent in a myriad of personal data generated in real time in the IOT environment and the data subject to protect personal data are in conflict with one another. In this conflict phase, the fact that the self-determination authority of the data subject has become virtually defective due to the data gap and the methods and means of seizing personal data are considered to be difficult to prove, even if personal data infringement occurs do. Based on these considerations, the following suggestions are made. First, a reasonable level of anonymization of personal data should be accepted as a social constraint that members of IoT society should recognize for the benefit of the community. Secondly, it is necessary to solve the digital divide existing between data processors who want to create new value by using personal data and simple users who want to enjoy the benefits, and to improve the responsibility of data processors by using legal system such as ‘PbD’. Third, national effort to institutionalize ‘STIX’(Structured Threat Information eXpression) should be strengthened so that illegal access to personal data and social community monitoring of misuse and abuse of personal data can be realized in real time. Finally, I hope that the legislative policy toward ‘Digital First’ in each country will become a competition stage of wisdom for ‘Positive-Sum’ at global community level.
