공직자에게 이해충돌의 문제가 중요하듯이 법관의 경우에도 이는 마찬가지이다. 그중에서 법관의 주식보유 및 거래는 이해충돌의 주요한 쟁점 중 하나라고 할 수 있다. 그럼에도 불구하고 해당 주제에 대해서는 충분한 논의가 이루어졌다고 보기에는 힘든 실정이다. 이 글은 법관의 주식보유 및 거래에 관한 외국의 사례를 영국과 미국을 중심으로 하여 소개함으로써 해당 주제에 대한 앞으로의 논의의 단초를 제공하는 것을 목적으로 한다. 우선 법관의 주식보유 및 거래에 관한 영국과 미국의 사례를 규정과 대표적 판례를 중심으로하여 소개하고, 다음으로는 해당 국가의 사례에서 현행 우리의 제도에 어떤 시사점을 줄수 있는지를 간략히 제시하고자 한다.
Abstract
Conflicts of interest are as critical for judges as they are for public officials. Specifically, the ownership and trading of stocks by judges represent a significant conflict of interest issue. However, this topic has not received adequate attention. The purpose of this article is to present foreign cases related to judges’ stock ownership and trading, with a focus on the UK and the US, in order to initiate discussions on this subject. The article will initially introduce cases from the UK and US concerning judges’ shareholdings and transactions, emphasizing regulations and illustrative case law. Subsequently, it will briefly examine the implications of these cases for our current system.
