2009년 2월 법무부에 민법개정위원회가 설치됨에 따라 그 동안 민사법학계의 오랜 숙원이었던 민법개정작업이 본격적으로 진행되고 있다. 4년 예정으로 민법의 현대화와 국제화를 지향하는 이번 개정작업은 그 양과 질에 있어서 지금까지와는 전혀 다른 차원에서 진행되고 있다. 이 글은 민법개정의 중요내용인 계약 및 법률행위에 관한 개정작업의 경과를 보고하기 위한 것이다. 구체적으로 법률행위 및 의사표시에 관한 규정, 대리에 관한 규정, 무효와 취소에 관한 규정 및 계약의 성립에 관한 규정 등을 대상으로 하는 민법개정위원회 제1분과 위원회의 첫 2년 동안의 작업의 경과와 결과를 보고한다.
Abstract
The Korean Civil Act is now under revision and the main purpose of the revision is modernization and globalization. In 2009 Ministry of Justice organized Civil Act Amendment Commission (hereafter "Commission") and delegated authority of making a revised Bill of the Civil Act to the commission. The commission consists of 5 sub-committee. This paper aims to report the work of the sub-committee No.1 (hereafter "sub-committee"). The sub-committee deals with the provisions relating to Juristic Acts, Declaration of Intention, Agency, Nullity and Voidance, and Formation of Contract. The sub-committee prepares the amendment of some Articles as well as new provisions. The members of the sub-committee try to keep the equilibrium between the contradictory principles and suggest the reasonable solution to settle the conflict of interests. The author, as chairperson of the sub-committee, reports the progress of the last 2 years work.
