Abstract

On February 24, 2022, the Russo-Ukrainian war broke out due to the bombing of Russian troops. As war progresses throughout Ukraine and prolonged, the number of civilian casualties is increasing significantly, which is causing a lot of public outrage to the international community. Contrary to Russia's emphasis on the legitimacy of the war, killings of civilians, which can be regarded as international crimes, have been continually reported, and more than 13,000 casualties have occurred even in situations where it is difficult to count accurate victims. Furthermore, considering that the victims will increase as the war continues, it is necessary to conduct international criminal law reviews on the killing of civilians. Therefore, this study reviews the possibility of criminal punishment for Russia’s civilian murder based on the ‘Rome Statute of the International Criminal Court’, which came into force based on the international agreement that the most serious crimes of concern to the international community should be punished. This study briefly points out the concept of each regulation, focusing on genocide, crimes against humanity, and international criminal procedures, reviews the possibility of inclusion of international crimes committed by Russia and the effectiveness of international criminal law regulations, and suggests the limitations and direction of improvement. Furthermore, a legislative amendment is proposed to improve the efficiency of criminal punishment by supplementing the limitations of each regulation, focusing on the case of Bucha massacre in which a large-scale civilian murder was committed. First, in the case of genocide stipulated in Article 6 of the Rome Statute, it is impossible to regulate the killing of countless groups not prescribed for protection, and there is a limitation that punishment is impossible if the so-called ‘special intent’ of genocide cannot be proven. Article 6 (a) of the ICC EOC, a regulation that subsidizes the Rome Statute, stipulates that the conduct took place in the context of a manifest pattern of similar conduct directed against that group or was conduct that could itself effect such destruction, further limiting the scope of establishment of genocide without reasonable grounds. Therefore, this study suggests a desirable judicial attitude and amendments to the provisions, in order to increase the effectiveness and deterrence of the norm of genocide. Next, in the case of crimes against humanity stipulated in Article 7 of the Rome Statute, there are limitations in that the act of attack must be widespread or systematic, and the relationship between the perpetrator's act of attack and the policy of the state or organization must be proven. In particular, Article 7, introduction, Paragraph 3 of the ICC EOC stipulates that the state or organization must actively promote or encourage such an attack against a civilian population, further reducing the possibility that killings of civilians in wartime are included in crimes against humanity, and has therefore been criticized. Therefore, this study proposes an amendment that deletes the last sentence of the relevant clause to alleviate the practical requirements for establishing the concept of crime and to further enhance the level of protection for civilians during wartime. Even though the killings of civilians in wartime are included in the crime of genocide or crimes against humanity, the criminal procedure of the ICC has limitations in that the possibility of legal adjudication is remote, due to the fact that it is difficult to prevent non-compliance of cooperation by non-parties to the Rome Statute, and that it can be neutralized by the veto power of permanent members of the UN Security Council. Accordingly, this study proposes the establishment of a special tribunal for Russian-Ukrainian and the addition of an article allowing trial in absentia to the Rome Statute in order to supplement the limitations of criminal procedure.
