Abstract

The landscape of electronically stored information(ESI) presents a multifaceted challenge in modern legal proceedings, characterized by its ubiquitous presence across diverse mediums and locations. This ubiquity, coupled with the ease of generation, storage, and retention, leads to an exponential proliferation of electronic data, thus imposing substantial costs on discovery of ESI(e-discovery). Notably, the expenses incurred throughout e-discovery, from preservation to collection, processing, and submission, register annual escalations. In jurisdictions like the United States, where pre-trial discovery mechanisms are robust, parties often find themselves compelled to settle matters prior to trial, primarily due to the considerable burden imposed by discovery costs. Such costs assume paramount economic significance, influencing the decision to litigate and carrying the potential to impede the exercise of substantive legal rights. The allocation of litigation expenses emerges as a pivotal concern, impacting not only the immediate parties but also the overarching efficacy of the civil litigation framework. Consequently, there arises a pressing necessity to deliberate on the equitable distribution of costs associated with e-discovery among involved stakeholders. The United States stands as an instructive jurisdiction for comparative analysis, given its rich repository of legal precedents delineating the allocation and burden of costs in e-discovery. This paper delves into the regulatory framework governing cost allocation for discovery under the Federal Rules of Civil Procedure, alongside pertinent federal court jurisprudence, critically engaging with scholarly discourse on associated lacunae and challenges. Rooted in this examination is an endeavor to elucidate procedural fairness by exploring methodologies and modalities for cost allocation in e-discovery. Acknowledging the inherent disparities in evidentiary proceedings and cost taxation structures between jurisdictions like the United States and Korea, a nuanced approach to comparative legal studies is warranted. Moreover, the dynamism inherent in litigation processes, underscored by multifaceted influences on procedural fairness, underscores the complexity of predicting the impact of singular factors, such as litigation costs. While the focus of this inquiry is circumscribed to the inhibitory effects of cost burdens associated with e-discovery on litigation initiation and their potential as incentives for pre-trial settlements, a broader consideration of the extensive discourse surrounding e-discovery costs in the United States promises to illuminate principles conducive to equitable discovery cost allocation within our legal framework. Such discussions serve as a foundational cornerstone for fostering meaningful dialogue essential to the realization of fair, cost-effective, and expeditious civil litigation practices.
