미국과 일본의 토지은행제도에 관한 고찰

Abstract

Land Bank refers to a land bank account set up within the Korea Land and Housing Corp.(L&H Corp.) in 2010. The launch of the land bank was behind high land prices and soaring land prices. In other words, the government’s construction of roads or railroads, which are national infrastructure, has incurred astronomical construction costs due to high land prices and soaring land prices. Land Bank system were introduced in order to solve these problem, However, recent changes in land prices have remained around 1-2 percent since the end of the 2000s, and both the population growth rate and the economic growth rate have been gradually decreasing. Because of these conditions, Many people are raising questions about the function and existence of the land bank. On the other hand, it seems that the U.S. and Japan are using the Land Bank to solve problems arising from empty houses and vacant lots that exist everywhere rather than stabilizing the land market. In addition, land banks were authorized to acquire ownership of the property in order to solve the problem of empty houses or vacant lots. Under these authority, the government could acquire property that was left unattended or abandoned as there existed many heirs and thus take proper care or disposal.This does not mean that there is a disadvantage to owners of real estate or other properties. For them, appropriate relief procedures are in place in the related laws. Therefore, in this paper, I will obtain implications from the land banking system in the United States and Japan in order to find the meaning of the present land banking system amid questions about the current functions of the land banking system in our country. Concretely, in Chapter 2 and Chapter 3, I will examine the relevant laws of the land banking system in the U.S. and Japan, and in Chapter 4, I will suggest on implication for the revitalization of the land banking system in the future by analyzing the functional limitations and problems of the land banking system in our country.
