Abstract

The purpose of this study is to understand recent laws and lawsuits related to climate change in some countries. One of the new trends in climate change litigation is human rights based litigation. Climate change litigation is being addressed not only from the economic and political point of view, but also from the human rights standpoint. Although the international community is increasingly suing for climate change, the United States does not provide this basis on federal court. In addition, the Public Trust Doctrine (PTD) is potentially compatible with each country. Because it can claim that the State has a fundamental obligation to protect the environment, which is a public trust resource, in accordance with the duties of the trustee. In many countries, the principle of public trust is introduced, but its scope is not clear. General principles of international environmental law, including prevention, intergenerational equity and principles of sustainable development, can also be used in litigation. Next, China has been institutionalized and opened up the possibility of a public interest lawsuit. Philippines has designed policies and systems for cooperation with the international community. In India, the legal system for protecting the individual rights was insufficient. But India’s courts orders research related to climate change for the better judgment. In the United States, the judiciary has recently begun to recognize the validity of the plaintiffs. Also, lawsuits and joint responses through NGOs and community will be appropriate for the U.S. The possibilities and limitations of RCRA as a means to adapt to climate change were also diagnosed. Based on human rights, RCRA provides a means to protect those who are poor. When ecating laws on climate change adaptation, this case study will be helpful in designing a preventative system in Korea.
