정당은 헌법적 보장을 받는 조직으로서 당원의 자율적 참여에 의한 의사결정을 전제로 하고 있다. 또한 국민의 정치적 의사형성 및 국가의 정치적 의사결정에 직접적인 영향력을 행사할 수 있는 지위에 있다. 그러나 우리나라 정당은 인물중심의 정당, 동원에 의한 당원의 참여, 하향적 의사결정구조 등 정당구조의 비민주성이라고 하는 아주 큰 문제점을 가지고 있다. 이러한 이유로 헌법과 정당법 등에는 당내 민주주의와 관련한 내용을 규정하고 있다. 그러나 실제로 우리나라의 정당은 민주적으로 운영된다고 할 수 없다. 따라서 정당이 국민의 신뢰를 회복하고 국민의 정치적 의사형성에 기여하기 위해서 정당법과 당규를 개정할 필요성이 있으며, 정당의 기능을 강화하기 위한 정당법과 당규의 모델을 독일 기본법상의 정당제도에서 찾아볼 수 있다. 당내민주주의가 정착되지 않으면 국가의 민주주의가 위태롭게 될 수 있다. 그러므로 당내민주주의를 제고할 수 있는 법적 방안을 헌법의 테두리 내에서 모색하는 것이 필요하다고 할 수 있다.
Abstract
Political parties are organizations that come under the protection of constitutional law. It has the premise of executing the decision making process by voluntary participation of its members. In addition, it is at a position where it can exercise its direct influence on political decision making of the government as well as the formation of opinions on political matters on the part of the citizens. However, Korean political parties have a big flaw called structural nondemocracy within its political parties in cases where there are top down decision making processes, member participation through rallying as well as centering upon a main figurehead. Due to these reasons, the constitutional law and political parties law have certain strict stipulations regarding the contents about democracy within the political party. Despite such regulations however, Korean political parties cannot be said to be run under democratic means. Therefore, in order for political parties to recover the trust of the citizens and to contribute to political opinion formation of the citizens, reforms need to be made with the political party law and its regulations. Also, in order to strengthen the functions of the political parties, we could look toward the German political party system under basic law as a proper model to find the improvement directions. If the democracy within the political party does not get settled, the nation's democracy itself may be threatened. As such, we could say that there is an absolute need to search for legal resolutions within the boundaries of the constitutional law which would allow democratic enhancements within political parties.
