The Aim of this Article is to review the matters of the Fundamental Rights of ‘Immigrant Children’ in Korea. The number of foreigners residing here exceeded one million _ 2 percent of the total population _ for the first time. But this has also brought about an increase in related problems. The government has taken a passive role in immigration control, which has made the situation worse. Immigrant Children in Korea have difficulty in adjusting to Korean society due to cultural differences and language barriers. They also face severe discrimination and are alienated. We recognize that the rights of immigrant children are continuously violated without proper law system and the political will. But immigrant children's rights must be protected more than immigrant workers. And it must be based on the constitutional law and international human rights. Thus in order to guarantee the rights of migrant children, the laws redefined migrant children as holders of rights. And we claim to legalize the status for all immigrant children and to endow them with the right of permanent residence, family unification and education.
