Abstract

These days, industrial development leads to increased value of relevant technology, thus, industrial technology is essential for corporations to ensure competitiveness and continuous development of the national economy. Generally, industrial technologies are protected as trade secrets, and subject to 「the Unfair Competition Prevention and Trade Secret Protection Act」 and 「Act on Prevention of Divulgence and Protection of Industrial Technology Act」. In this article/paper, I closely examine methods for the improvement of the problems in legislation during interpreting and applying these Acts. 「The unfair Competition Prevention and Trade Secret Protection Act」 needs to be improved in terms of expansion of the duty to submit documents, introduction of the duty to provide explanations, institution of an order to maintain confidentiality, institution of hearings closed to the public, institution of punitive damages, and improvement of calculation of monetary penalties. 「The Act on Prevention of Divulgence and Protection of Industrial Technology」 is in need of distinctive conceptualization of industrial technology, improvement of methods for selection of members of a professional commission, arrangement of regulation on national critical technologies subject to reporting, improvement of education on confidentiality, institution of regulations against seizure of foreigners, by acquisition, merger or such, of the management rights of domestic businesses holding critical technologies, and institution of regulations for new certification and qualification systems which create a foundation for self-protection of the market.
