본고는 남북한 관광법규(혹은 규정)의 비교를 통해, 통일 이후 관광법규의 통합 가능성을 모색한 글이다. 이를 통해 남북한 관광 관련 법‧제도를 통합하고 조정할 수 있는 기초를 마련할 수 있다. 남북한 관광 법제 제정과 변천과정을 고찰하고, 현행 남북한 관광 법제 비교를 통해, 남북한 관광법규(혹은 규정)의 유사점과 차이점을 도출한다. 남북한 교류가 활발할 때, 정치/경제/사회/문화 분야의 변화는 많이 다루어지나, 여러 분야에 파급효과를 가져오는 관광 분야는 거의 다루어지지 않고 있다. 이러한 현실에도 불구하고, 그동안 금강산 관광, 개성 관광 등 관광 분야는 남북한 교류에 있어 지대한 공헌을 해 온 것이 사실이다. 본고는 관광에 관한 인식을 환기시키고, 통일 이후 남북한 관광 관련 법 제도를 통합하고 조정하는데 기여하고자, 남북한 관광법규를 비교 고찰하여 통일 이후 관광법규의 방향과 흐름을 제시한 것이다.
Abstract
The purpose of this thesis is to compare the tourism laws of South and North Korea to explore possibilities of integrating the two laws after reunification. By exploring them, it is possible to lay the foundations for integrating and coordinating the laws and systems related to tourism in the two Koreas. It examines the process of enactment and transition of the tourism laws in South and North Korea, and also examines the similarities and differences between the two Koreas through the comparison of the current tourism laws to integrate the two different laws. When exchanges between South and North Korea started, changes in political, economic and social fields were very commonly handled, but the tourism sector, which has a ripple effect on various fields, was scarcely handled. In spite of this reality, the tourism sector such as Mt. Kumgang tour and Kaesong tour have contributed greatly to the interchange between the two Koreas. Therefore, it is a meaningful task to arouse awareness of tourism by comparing the two different tourism laws and their trends before reunification.
